A bidder's bond shall include a certified copy of the power of attorney. All bids must be accompanied by an affidavit certifying that, (1) the bid has been arrived at by the bidder independently, and has been submitted without collusion with, and without agreement, understanding or planned common course of action with any other vendor of materials, suppliers, equipment or service described in the invitation to bid, designed to limit the independent bidding or competition, (2) the contents of the bid has not been communicated by the bidder or its employees or agents to any person not an employee or agent of the bidder or its surety on any bond furnished with the bid, and will not be communicated to any such person prior to the official opening of the bid. The affidavit shall be signed by the bidder if he is an individual, by a partner if the bidder is a partnership, or by an officer or employee of the corporation having power to sign on its behalf, if the bidder is a corporation. The affidavit shall state that the person signing it has fully informed himself regarding the accuracy of the statements made in it. Any bid not accompanied by this affidavit will be rejected. The Council reserves the right to, (1) defer acceptance of any bid, not to exceed 40 days, (2) reject any or all bids, (3) waive any informalities and technicalities.
