Site Address: 17510 Bethel Rd, Shawnee, OK 74801 Question Deadline 02/07/2025 Every request for such interpretation should be in writing and addressed to: WDB ENGINEERING P.L.L.C. 6330 S.E. 74 TH Street, Oklahoma City, OK 73135 and to be given consideration must be received at least five days prior to the date fixed for the opening of bids 17,627 L.F. 12" DR-11 Poly Waterline - Labor Only 300 L.F. DR-11 Poly Directional Bore - Labor Only 65 L.F. 8" DR-11 Poly Waterline - Labor Only 20" and 16" Bore and Steel casing - Labor and Materials All appurtenances for a fully functional system as described in plans and specifications. Contractor shall be responsible for covering costs of railroad insurance and flagman during construction. Contract Consists of Furnishing and Constructing All Material and Equipment for a 12" Raw Water Line to Dale Wtp as Shown in the Plans and Described in the Specifications. The information for Bidders, Form of Bid, Form of Contract, Specifications, and Form of Bid Bond, Performance and Payment Bond, and other contract documents may be examined at the following: WDB Engineering PLLC 6330 S.E. 74TH Street Oklahoma City, OK 73135 Hard copy sets may be mailed to the bidder ONLY if the bidder provides a FedEx or UPS account number to the sender, WDB Engineering, PLLC. Refunds will not be made. The Owner may consider informal any bid not prepared and submitted in accordance with the provisions hereof and may waive any informalities or reject any and all bids. Any bid may be withdrawn prior to the above scheduled time for the opening of bids or authorized postponement thereof. No bidder may withdraw a bid within 60 days after the actual date of the opening thereof. The Owner reserves the right to reject any bid if the evidence submitted by, or investigation of such bidder fails to satisfy the Owner that such bidder is properly qualified to carry out the obligations of the contract and to complete the work contemplated therein. Conditional bids will not be accepted. Each bid must be submitted in a sealed envelope, bearing on the outside, the name of the bidder, his address, and the name of the project for which the bid is submitted. If forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed as specified in the bid form. A Conditional or qualified Bid will not be accepted. 3. Subcontracts The bidder is specifically advised that any person, firm, or other party to whom it is proposed to award a subcontract under this contract shall be subject to acceptance by the Owner. Approval of the proposed subcontract award will not be given by the Owner unless and until the proposed subcontractor has submitted certifications and/or other evidence required by the Owner attesting to the subcontractor's qualifications. 4. Telegraphic Modification Any bidder may modify his bid by telegraphic communication at any time prior to the scheduled closing time for receipt of bids, provided such telegraphic communication is received by the Owner prior to the closing time, and provided further the Owner is satisfied that a written confirmation of the telegraphic modification over the signature of the bidder was mailed prior to the closing time. The telegraphic communication should not reveal the bid price but should provide the addition or subtraction or other modification so that the final prices or terms will not be known by the Owner until the sealed bid is opened. If written confirmation is not received within two days from the closing time, no consideration will be given to the telegraphic modification. Bid Security Each bid must be accompanied by cash, certified check of the bidder, or a bond prepared on the form of bid bond attached hereto, duly executed by the bidder as principal and having as surety thereon a surety company approved by the Owner, in the amount not less than 5% of the bid. Such cash, check or bid bond will be returned, if requested, to all except the three lowest bidders within three days after the opening of bids, and the remaining cash, check or bid bond will be returned, if requested, promptly after the Owner and the accepted bidder have executed the contract, or if no award has been made within 30 days after the date of the opening of bids, upon demand of the bidder at any time thereafter, as long as he has not been notified of the acceptance of his bid. Security for Faithful Performance Simultaneously with his delivery of the executed contract, the Contractor shall furnish a Performance Bond, Statutory Bond and Maintenance Bond or Bonds, each in the amount of 100% of the contract price, as security for faithful performance of this contract and for the payment of all persons performing labor on the project under this contract and furnishing materials in connection with this contract, as specified in the General Conditions included herein. The surety on such bond or bonds shall be a duly authorized surety company satisfactory to the Owner. Liquidated Damages for Failure to Enter into Contract The successful bidder, upon his failure or refusal to execute and deliver the contract and bonds required within 10 days after he has received notice of the acceptance of his bid, shall forfeit to the Owner, as liquidated damages for such failure or refusal, the security deposit with his bid. Time of Completion and Liquidation Damages Bidder must agree to commence work on or before a date to be specified in a written "Notice to Proceed" of the Owner and to fully complete the work within 120 consecutive calendar days thereafter. Bidder must agree also to pay as liquidated damages, the sum of $600.00 for each calendar day thereafter as hereinafter provided in the General Conditions. Every request for such interpretation should be in writing and addressed to: WDB ENGINEERING P.L.L.C. 6330 S.E. 74TH Street, Oklahoma City, OK 73135 and to be given consideration must be received at least five days prior to the date fixed for the opening of bids. Inspection Trips if Requested by Any of the Bidders an Inspection Trip May Be Coordinated With the Chairman of the Pottawatomie County Rural Water District No. 3.
