Wastewater Treatment Plant Capacity Upgrade All bid proposals must be on the form provided and must be accompanied by a bid proposal deposit in cashier's check, postal money order, or surety bond, on the form provided, in an amount equal to five percent (5%) of the amount of the bid proposal. The amount of the surety bond may be stated either as a dollar amount or as a percentage of the bid proposal. Should the successful bidder fail to enter into such contract and furnish satisfactory payment and performance bonds within the time stated in the Standard General Conditions of the Construction Contract prepared by Engineers Joint Contract Documents Committee, then the bid proposal deposit shall be forfeited to the City of Bainbridge Island. Bids must be sealed with the outside of the envelope marked by the PROJECT NAME AND BID OPENING DATE. The name and address of the bidder should also appear on the outside of the envelope. Faxed or electronic bids and/or surety bonds will not be accepted. After the date and hour set for the opening of bids, no bidder may withdraw its bid unless the award of the contract is delayed for a period exceeding 90 working days following the bid opening. All bidders agree to be bound by their bids until the expiration of the stated time period. NATURE OF IMPROVEMENT: The Contractor shall provide all labor, materials, tools, equipment, transportation, supplies, and incidentals necessary for the following major elements: Purchase and installation of an ultraviolet disinfection system, uninterruptable power supply, and secondary treatment upgrades for the City of Bainbridge Island, wastewater treatment plant. The City of Bainbridge Island reserves the right to reject any or all bids and to waive informalities in the bidding process. The contract will be awarded to the lowest responsible bidder in compliance with 40 CFR 31.36 (d)(2)(ii)(D) and 40 CFR 31.36 (d)(2)(ii)(B). Bidders must meet the mandatory responsibility criteria required by RCW 39.04.350 and any supplemental criteria described in the Contract Documents. Bidders should verify they meet the responsibility criteria before submitting a bid. It is anticipated that this project will be funded in part by the Washington State Department of Ecology. Neither the State of Washington nor any of its departments or employees are, or shall be, a party to any contract or any subcontract resulting from this solicitation for bids. The Successful bidder will be required to conform to the wage requirements prescribed by the federal Davis-Bacon and Relate Acts which requires that all laborers and mechanics employed by contractors and subcontractors performing on contracts funded in whole or in part by SRF appropriations in excess of $2000 pay their laborers and mechanics not less than the prevailing wage rates and fringe benefits, and determined by the Secretary of Labor, for corresponding classes of laborers and mechanics employed on similar projects in the area Title VI Notice: The City of Bainbridge Island, in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, Subtitle A, Office of the Secretary, Part 21, Nondiscrimination in Federally-Assisted Programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively ensure that, in any contract entered into pursuant to this advertisement, disadvantaged business enterprises as defined at 49 CFR Part 26 will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, or sex in consideration for an award.
