Contracts for purchase will be made from the lowest and/or best bids submitted, but the Mayor and Board of Aldermen reserve the right to reject any and all bids, and accept or reject any part of a bid. the prices quoted will be binding for the period from APRIL 1, 2025 THRU SEPTEMBER 30, 2025, unless otherwise indicated. Contracts for purchase will be made from the lowest and/or best bids submitted, but the Mayor and Board of Aldermen reserve the right to reject any and all bids, and accept or reject any part of a bid. The City reserves the right to reject any and all bids and to waive minor irregularities and technicalities which do not detract from the best interests of the City. When necessary to ensure ready availability of services, supplies, or for public projects and the timely completion of public projects, the Mayor and Board of Aldermen reserve the right to accept no more than two alternate bids. However, no purchases will be made through alternate bidders unless the lowest and best bidder, for reasons beyond his control, cannot deliver the commodities or services contained in his bid in a timely manner. In that event, purchase of such commodities or services may be made from one of the bidders whose bid was accepted as an alternate. Bid Security: Each bid for labor must be accompanied by a certified check of the bidder or a bid bond, prepared on the form of a bid bond duly executed by the bidder as principal and having as surety thereon a surety company licensed by the State of Mississippi and signed by an agent resident in Mississippi in the amount of Five Percent (5%) of the total bid for each labor category for which a bid is offered. Liquidated Damages for Failure to Enter into Contract (Labor Bids): The successful labor bidder, upon his failure or refusal to execute and deliver the contract and bonds required ten (10) days after he has received notice of the acceptance of his bid, shall forfeit to the Owner, as liquidated damages, the security deposited with his bid. Any contractor submitting a proposal for these services who fails to respond to the "Notice of Intent to Issue Work Order" and thus refuses to accept a "Work Order" may be disqualified from any future consideration of work for the remainder of the current bid term and the entire following term.
