For project information, please contact Trevor Mason at the Pomona Unified School District at (909) 5523134.Each bidder shall be a licensed contractor pursuant to the Business and Professions Code and shall possess a current Class "B" Contractors License. The Contract Time is 304 consecutive calendar days. Liquidated Damages shall be $500.00 per day for every calendar day after Substantial Completion. Prequalification of Bidders As a condition of bidding for this Project, and in accordance with California Public Contract Code section 20111.5, prospective bidders are required to submit to the District a completed set of prequalification documents on forms provided by the District. These documents will be the basis for determining which bidders are qualified to bid on this Project. Bids will not be accepted if a Contractor has not been fully prequalified where prequalification is required. Prequalification documents must be submitted and fully approved by the PQ Bids by 8:00 A.M. on Monday, March 3, 2025. Contractors will be notified by PQBids via email of their prequalification rating within a reasonable period of time after submission of their prequalification documents. Please note, when renewing existing prequalification status, applications should NOT be initiated within a week of prequalification deadline. This Project includes work that will be performed by mechanical, electrical or plumbing ("MEP") subcontractors that hold "C7", "C10", and/or "C36" licenses, and such MEP subcontractors must also be prequalified. A list of prequalified MEP subcontractors will be made available by the District to all bidders at least five business days prior to the bid opening date. It is the responsibility of the bidder to ensure that all MEP subcontractors holding any of the licenses listed above are properly prequalified before submitting a bid. Labor Compliance Requirements All contractors must comply with the all applicable labor compliance requirements under the California Labor Code, including but not limited to, registration with the Department of Industrial Relations (Labor Code Sections 1771.1(a) and 1725.5), 1771, 1771.4, 1773.2, 1774, 1776, 1777.5, 1813, and 1815. SB 854 Department of Industrial Relations: SB 854 (Stat. 2014, chapter 28) made several changes to the laws governing how the Department of Industrial Relations (DIR) monitors compliance with prevailing wage requirements on public works projects. Prevailing wage applies to project over $1,000.00. Pursuant to California Labor Code Section 1771.1(a), as amended by SB 854, a contractor may not bid, nor be listed as a subcontractor, for any bid proposal submitted for public work or engage in the performance of any contract for public work unless registered and qualified to perform public work pursuant to Labor Code Section 1725.5, subject to limited legal exceptions. As a result, no contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with DIR. All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement). To comply with the DIR guidelines, the District will disqualify any contractor (and subcontractor) who is not registered with the DIR at the time the bid (or prequalification) package is opened, the award will go to the next low responsible bidder who is registered with the DIR. This project will be subject to compliance monitoring and enforcement by the DIR, pursuant to California Labor Code Section 1771.4. In addition to submitting certified payroll records directly to the Labor Commissioner, the awarded contractor must also provide one original set of certified payroll records to the District's Purchasing Department. No bid may be withdrawn for ninety (90) days. Any Contractor bidding on the Project who fails to attend the entire mandatory job walk and conference will be deemed a nonresponsive bidder and will have its bid returned unopened. All bidders will be responsible for obtaining any addendums or revisions to the project. It is the contractor's responsibility to attend the requested PreBid Conference and Job Walk to ensure accurate project bid cost(s) and any pertinent information. Each bidder shall submit, on the form furnished with the contract documents, a list of subcontractors to be used on this project as required by the Subletting and Subcontracting Fair Practices Act, California Public Contract Code Section 4100 seq. Each bidder must submit with each bid a cashier's check payable to the District or a bid bond in the form set forth in the contract documents in an amount not less than ten percent (10%) of the maximum amount of bid as a guarantee that the bidder will enter into the proposed contract if the same is awarded to such bidder. In the event of failure to enter into said contract, such security will be forfeited. The District reserves the right to reject any and all bids, to make multiple or "split" awards (if applicable), and to waive any irregularities in any bid. Bids shall not be solicited from, nor any order placed with any company that: A Is owned, controlled, or actively influenced by any District employee or immediate relative of said employee; Employs in a management, consulting, or sales capacity any person who is a District employee; A Employs in any capacity a District employee who is in a position to influence the selection of, or conduct business with, such vendor. Renovation of (7) toilet rooms at Emerson M.S. 1.4 ACCESS TO SITE A. Coordinate with the construction manager for access to site. There will be not school in session during the summer break. However, such condition might change, and it is the contractor’s responsibility to work around school schedule to minimize the impact to classes, including working extended hours (nights and weekends) at no additional cost to the District. 1.5 WORK RESTRICTIONS A. Work Restrictions, General: Comply with restrictions on construction operations. 1. Comply with limitations on use of public streets and with other requirements of authorities having jurisdiction. 2. The School may be occupied during construction. Contractor shall not disturb the campus’ daily operations. Coordinate with the construction manager for access. 3. Work hour: in accordance with the City’s ordinance and/or as specifically instructed by the District. 4. Contractor shall clean up the work and make sure the affected areas are clean at the end of their work shift.
