Renovation of a mixed-use development in Novato, California. Completed plans call for the renovation of a clubhouse / community center; and fitness / recreation center.

The work consists of overlaying the existing roofs at two city owned sites. The project includes but is not limited to roofing, flashing, photovoltaic panel removal and reinstallation, parapet siding replacement, and other minor improvements. Bids are required for the entire work described herein. The contractor shall possess either a Class B license or Class C- 39 at the time this contract is awarded. This contract is subject to state contract nondiscrimination and compliance requirements pursuant to Government Code, Section 12990. The City of Novato hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement; small business and disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation. Contractors are encouraged to contact small businesses and disadvantaged business enterprises for subcontract work that they might otherwise perform with their own forces. Pursuant to Section 1773 of the Labor Code, the general prevailing wage rates in the county, or counties, in which the work is to be done have been determined by the Director of the California Department of Industrial Relations. These wages set forth in the General Prevailing Wage Rates for this project are available from the California Department of Industrial Relations' Internet web site. Addenda to modify wage rates, if necessary, will be issued to holders of the Bid Documents. Future effective general prevailing wage rates which have been predetermined and are on file with the California Department of Industrial Relations are referenced but not printed in the general prevailing wage rates. The contractor shall be registered with the Department of Industrial Relations (DIR) pursuant to 1725.5 of the Labor Code to be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any public work contract that is subject to the requirements of this chapter. For the purposes of this section, "contractor" includes a subcontractor as defined by Section 1722.1. Pursuant to the provisions in Section 1771.1 of the Labor Code a contractor or subcontractor shall not be qualified to engage in the performance of any contract for public work, unless currently registered and qualified to perform public work pursuant to Section 1725.5. It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business and Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded. The City reserves the right to reject any and all bids, to waive any informality in a bid, and to make award as the interests of the City may require. This notice is given by order of the City Council of the City of Novato, California. In accordance with California Public Contract Code Section 3400, bidders may propose equals of products listed in the technical specifications or project plans by manufacturer name, brand or model number, unless the technical specifications or plans specify that the product is necessary to match others in use. Complete information for products proposed as equals must be submitted to the City for review at least 5 working days before the time specified for bid opening in accordance with the bidders instructions contained in the bid package. No bid will be received unless it is made on proposal forms furnished by the City Engineer. Each proposal must be accompanied by a certified or cashier's check or bid bond in the amount of ten percent (10%) of the estimated aggregate amount of the bid as a guarantee that the bidder, if the award is made to him/her in accordance with the terms of his/her proposal, will promptly execute a contract in the required form, secure payment of worker's compensation insurance, and furnish a satisfactory, faithful performance bond and a labor and material bond. Each of said bonds shall be in the sum of not less than one hundred percent (100%) of the estimated aggregate amount of the payments to be made under the contract computed on the basis of the price stated in the proposal. In addition to the above, and if requested by the City, the bidder shall furnish a financial statement of recent date. Failure to comply with this requirement will render a bid informal and shall be sufficient cause for rejection. The contract agreement will not be signed by the City Manager until the Contractor provides a copy of a current City of Novato business license. A complaint can also be filed online at the DOT's Office of Inspector General website. Anyone with knowledge of possible bid rigging, bidder collusion, or other fraudulent activities should use the "hotline" to report these activities. The "hotline" is part of the DOT's continuing effort to identify and investigate highway construction contract fraud and abuse and operated under the direction of the DOT Inspector General. All information will be treated confidentially and caller anonymity will be respected.
