Buffalo and Erie County Public Library - Various Capital Projects Term Agreement PROJECT LOCATION: Buffalo & Erie County Public Library 1 Lafayette Square Buffalo, New York 14203 The Erie County Department of Public Works - Division of Buildings and Grounds (herein also referred to as "The County") is seeking Qualification Statements for an Architectural & Engineering consultant to provide oncall professional services related to the project described above. Services to be provided are on-call for the Erie County Dept. of Public Works, and/or any other Erie County Department by request. Work will be limited to the Building described above and in general, the work will include, but is not limited to; replacement of the current Rare Book Room HVAC system with a museum quality system, the replacement of two (2) 1997 Cleaver/Brooks boilers, the replacement of two (2) 750 HP hydropulse snow melt boilers with investigation of adding a heat exchanger to supplement snow melt boilers with building hot water system, and the replacement of the original 1962 air handler units to include a Siemens energy management system. Other assignments for the selected consultant will be assigned based on the needs of the facility as well as available funding. Scope of work may also include Engineering Consultation and/or review of other Architect/ Engineer Project Documents that were previously contracted by the County separately from this RFP/ RFQ. These services can include but not be limited to; review of drawings and specifications prepared by others for Building Code compliance, provide recommendations for repairs/ comments on construction documents, site visits to verify existing conditions, review of cost estimates prepared by others, review of prepared reports, and assistance Construction Administration as requested by the County. While this is a term agreement up to five (5) years in length, the Library as well as the County request two separate design fees, in addition to the Schedule E - Rates of Service requested. be included for the following two projects. These projects can be considered the first two assignments designed under the term contract and will begin once an official contract is issued. See the Proposal Forms included in Schedule F herein for all proposal forms associated with this RFP/ RFP. Project Assignment A - Exterior Marble Panel Stabilization Scope of work on these panels includes but is not limited to, removal and replacement of the caulk around the exterior of the marble panels, removal and replacement of any marble panels that have shifted, are damaged, or otherwise loose. Project Assignment B - Chiller Replacement Scope of work includes the replacement of two (2) 250 ton chillers and towers. The existing units are 25 years old and are approaching the end of their useful life. Included with this project will be the investigation of potentially implementing heat pump chiller technology using a heat exchanger to add heat to hot decks to prevent overcooling the building due to dehumidification. The ideal result of this potential implementation will be to properly use the Library's hot deck/cold deck mixing boxes as originally designed. replacing the units with heat pump units that can be utilized with heat in the summer to assist in cooling the building. The selection of the design consultant as part of this RFP/ RFQ will be based on the qualifications of the design firm and associated subconsultants (as applicable) as a whole to perform all duties described herein. Proposal fees provided for the Project Assignments summarized above are to be inclusive of all items described in Section A - Scope of Services. It shall be assumed that future assignments through the term agreement would also include all items as described in Section A - Scope of Services based on the negotiated fee. It shall be understood that the initial fee proposal for Project assignments above are provided as part of this RFP/ RFQ will be solely for the scope of work as summarized above. There may be some instances where the consultant personnel will be needed to address and/or assist County personnel in emergency situations, i.e.; a power outage due to construction activities, malfunction of County equipment or any other situation in which the Commissioner of Dept. of Public Works or the Director of Engineering deems to be an emergency. If engaged under an Agreement, the County shall reimburse the consultant for their costs established related to future scopes of work on their Rates of Service provided in Schedule E on a time and materials basis and/or as a negotiated lump sum fee which would be inclusive of services described in Section A - Scope of Services. Whether services are compensated based on rate of service or lump sum fee, future work will be assigned to the selected consultant through the term agreement on a case by case, per project basis. These assignments may be issued by the Department of Public Works, and/or other Erie County Departments as applicable. The design fee for future assignments will be negotiated between the consultant and the County based on the scope of work at hand. The County reserves the right to not award additional work if the negotiated fee cannot be agreed upon. The consultant must supply the staff necessary to complete these tasks. In the event the consultant does not possess some of the necessary staff, the firm must inform the county of lack of personnel. At the approval of the County, the On-Call consultant must then subcontract out for the necessary personnel their firm is lacking; a separate contract will not be issued by Erie County for this sub-consultant. The consultant selected as part of this RFQ will be retained for a period of three (3) years, with options to renew and extend the length of the term agreement by up to two (2) additional one (1) year terms as agreed upon by the County and consultant. There will be no change in the contract price, Rate of Service included in Schedule E or the terms and conditions for the three year term. Each of the one (1) year renewal options shall be subject to appropriation and/or continuation of funding upon agreement between the Consultant and the County with no changes to the terms and conditions. The contract will be administered by the Department of Public Works and/or any other Erie County Department by request. The County reserves the right to award an Agreement to a firm other than the firm offering the lowest fee multiplier. The Agreement resulting from this solicitation, if any, shall be awarded to the highest rated and responsible firm based on the evaluation criteria set forth in this RFQ/RFP. Nothing contained herein shall obligate the County to award an Agreement on the basis of this solicitation. The County reserves the right to award a contract to more than one firm ("Consultant") as it is recognized that different firms have varying levels of expertise. Work will be assigned on a case by case, per project basis. These assignments may be issued by the Commissioner of Public Works, Senior Construction Project Manager or other designated County Project Manager. The consultant engineer must supply the staff necessary to complete these tasks. In the event the consultant does not possess some of the necessary staff, the firm must inform the county of lack of personnel. At the approval of the County, the On-Call consultant must then subcontract out for the necessary personnel their firm is lacking; a separate contract will not be issued by Erie County for this sub-consultant. The selected consultant shall exhibit familiarity with State Historic Preservation (SHPO) approvals, State Environmental Quality Review (SEQR) including coordination of public input as needed and the NYS Dept Environmental Conversations (NYSDEC) compliance as needed to execute a given assigned scope or work. The consultant must show familiarity and expertise with incorporating the most current ADA codes and regulations in practice. The consultant is expected to demonstrate capability and provide all services for all disciplines (architectural, civil, structural, mechanical, electrical, plumbing, environmental, etc.) as it pertains to the scope of work at hand as a prime consultant with proposed subconsultants (as applicable) in full compliance with all the latest edition of the New York State Uniform Fire Prevention and Building Codes. Please submit three (3) bound hard copies and one (1) electronic PDF copy of your qualifications package along with one (1) hard copy of the Proposal Form - Term Agreement and Schedule E - Rates of Service on or before the date and time listed in Section C "Proposal Time Frames" inclusive of all required content as described Section H "Proposal Content" of this document. The term agreement Proposal Form shall be submitted in a separately sealed envelope along with the RFQ/RFP package as described above. The County is under no obligation to return proposals. For consideration the Consultant must submit both the qualification statements and proposal form. Proposal form shall be submitted in a separately sealed envelope along with the RFQ/RFP. A list of questions and answers will be posted online by issuance of an addenda. No communications of any kind will be binding against the County, except for the formal written responses to any request for clarification. The method of Contractor Selection has not been Determined at this time.
