Bids received after that time will be returned unopened. Envelopes shall be sealed and marked "Construction Trades Home Completion - Van Buren Tech Bid." All proposals shall be made in accordance with Bidding Documents. This project does not require a prevailing wage. Please indicate any additional information or options that are not listed in the specifications. Bid quotes are guaranteed for 90 calendar days. The Van Buren Intermediate School District reserves the right to accept or reject any or all bids, to waive any irregularities which it deems to be in the best interest of Van Buren Intermediate School District, and the right to award the contract to other than lowest bidder. AFFIDAVITS In compliance with MCL 380.1267, all bids shall be accompanied by a sworn statement disclosing any familial relationship that exists between the owner(s) or any employee of the bidder and any member of the Board of Education of the School District or the Superintendent of the School District. Also, a completed certification form as attached for compliance with the "Iran Economic Sanctions Act" is required with the bid proposal. The Board of Education shall not accept a bid that does not include the sworn and notarized disclosure statements. BID SECURITY All bids must include a Bid Security for five percent (5%) of the bid amount, including alternates, payable to the Van Buren Intermediate School District (VBISD), in either the form of a certified bank check or bid bond. If awarded the Contract, the awarded bidder will be required to provide a Performance Bond and Payment Bond in the amount of 100% of the contract price. It is understood that the bid security shall be retained as liquidated damages, not as a penalty, by the VBISD if the bidder withdraws the bid after being awarded the Contract, fails to enter into a Contract for performance in conformity with the provisions of the RFP or fails to furnish the required Performance and Payment Bonds within fourteen (14) days of receipt of Notice of Award. The Owner will have the right to retain the Bid Security of bidders to whom an award is being considered until either: a) The Contract has been executed and bonds have been furnished, b) The specified time has elapsed so that bids may be withdrawn, or c) All bids have been rejected. PERFORMANCE and PAYMENT BONDS Within fourteen (14) days of receipt of the Notice of Award and before issuance of Contract, the successful Bidder shall furnish Performance and Payment Bonds as required by MCL 129.201, et seq. in such form as the District may require, securing the faithful performance of such contracts and payment of all obligations arising thereunder. Such bonds must be for the full amount of the contract with a surety company in good standing and licensed in the State of Michigan. The bond must be at no cost to the District. CERTIFICATE OF INSURANCE Before commencement of any work, a Certificate of Insurance must be provided by the award bidder's insurance agent or carrier showing the required insurance coverage as follows: o Commercial Liability Insurance written on an occurrence policy form with limits of liability not less than $1,000,000 each occurrence, $1,000,000 aggregate, combined single limit, that includes coverage for your operations, personal injury, XCU (explosion, collapse and underground), independent contractors, contractual, and products completed operations. o Workers' compensation, including Employer's Liability Coverage, of $100,000 each accident, $500,000 annual aggregate, in accordance with all applicable Michigan law. Failure to provide the certificate may be considered a material breach of the agreement and may be grounds for terminating the agreement.
