The Town of Mount Pleasant (Town) shall receive Bids for year-round maintenance by a certified pool operator to provide splash pad maintenance in accordance with the attached Public Swimming Pools Regulation 61-51 for compliance with Type C public swimming pools, per the requirements of the SC Department of Environmental Services (formerly known as DHEC). Applicable sections of the regulation include J9, J13-15, J17-18, and J20-21. The splash pad will be operational tentatively mid-March through mid-October, with the required continued maintenance needed in the off season. This invitation does not commit the Town to award a Contract, to pay any costs incurred in the preparation of a Bid, or to procure or contract for the articles of goods or services. The Town reserves the right to waive any informalities or irregularities in the solicitation, to negotiate with all qualified Bidders, to accept or reject any or all Bids received as a result of this Invitation, to cancel in part or in its entirety and to award or refrain from awarding a contract to any Bidder, if it is in the best interest of the Town to do so. The Town of Mount Pleasant is currently in the third phase of constructing the Memorial Waterfront Park expansion that will enhance public enjoyment of the park. The expansion is almost entirely north of Harry Hallman Boulevard and includes a new splash pad that will be operational tentatively mid-March through mid-October with continued maintenance needed in the off season. It is the intent of the Town to award a Contract to the lowest, most responsive, responsible and qualified Bidder, determined to meet the special inspection testing services as stipulated and contained herein. Contract Period The contract period shall be for one (1) year, renewable annually for a period not to exceed sixty (60) months, and effective from the date of award. Contract Renewal Any Contract entered into as a result of this bid may be ratified and extended providing that renewal conditions as contained herein have been met and that such renewal would be in the best interest of the Town. Total Contract period including all renewals shall not exceed a combined period of sixty (60) months. Prior to ratification of renewal and Contract award for additional annual period the Town of Mount Pleasant and the successful Bidder shall negotiate the cost of installation and maintenance. Approximately thirty (30) days prior to expiration of existing Contract, the Town shall request the successful Bidder to submit their most favorable pricing for consideration for any renewal if desirable by the Town. The Town reserves the right to withhold payment or make such deductions as may be necessary to protect the Town from loss or damage because of defective work, claims, damages, or to pay for repair or correction of materials furnished hereunder.
