Project: Wheless Townhomes Offsite Located at: 1512 Wheless Lane Austin, Texas 78723 Maintenance Bond: If the Contract Documents contemplate a period of maintenance beyond the one (1) year contractual warranty period, OWNER agrees that any bond to be required for such maintenance work will be in the amount of the maintenance work during any extended maintenance period. The Work consists of the construction of approximately 725 linear feet of 24-inch wastewater interceptor pipe and 40 linear feet of 8-inch water main and appurtenances along Brookside Drive. The result of the bid opening does not become final until all bids are verified, and the bid tab is certified. The pencil bid tab and certified bid tab will be posted online. All Bids shall be accompanied by an acceptable Bid guaranty in an amount of not less than five percent (5%) of the total Bid, as specified in Section 00100, Instructions to Bidders. Performance and payment bonds when required shall be executed on forms furnished by OWNER. Each bond shall be issued in an amount of one hundred percent (100%) of the Contract Amount by a solvent corporate surety company authorized to do business in the State of Texas, and shall meet any other requirements established by law or by OWNER pursuant to applicable law. Contract Time is of the essence and all Work shall be substantially completed within One Hundred and Eighty (180) Calendar Days after date specified in the Notice to Proceed, in accordance with the Bid Form, Section 00300. Final completion shall be achieved within Sixty (60) Calendar Days after substantial completion. Liquidated damages are Six Hundred and Forty dollars ($640.00) per Calendar Day for failure to substantially complete the work and Three Hundred and Forty dollars ($340.00) per Calendar Day for failure to achieve final completion within Sixty (60) Calendar Days after substantial completion, in accordance with the Bid Form, Section 00300. OWNER reserves the right to reject any or all Bids and to waive any minor informality in any Bid or solicitation procedure (a minor informality is one that does not affect the competitiveness of the Bid).
