The Gwinnett County Board of Commissioners is soliciting competitive sealed bids from qualified contractors for the Purchase of Mitigation Credits for Stanley Road Relocation Project for the Department of Transportation. Questions regarding bids should be directed to Michael Milstein, Purchasing Associate II, at Michael.Milstein@gwinnettcounty.com or by calling 770-822-7811 no later than 3:00 p.m. March 7, 2025. Bids are legal and binding upon the bidder when submitted. All bids should be submitted in duplicate. Successful vendors will be required to meet insurance requirements. The Insurance Company should be authorized to do business in Georgia by the Georgia Insurance Department and must have an A.M. Best rating of A-5 or higher. All contractors must submit with bid, a bid bond, certified check or cashier's check in the amount of five percent (5%) of the total bid made payable to the Gwinnett County Board of Commissioners. Failure to submit a bid bond with the proper rating will result in the bid being deemed non-responsive. Successful supplier will be required to meet insurance requirements, submit a one hundred percent (100%) performance bond and a one hundred percent (100%) payment bond. Insurance and Bonding Company should be licensed to do business by the Georgia Secretary of State, authorized to do business in Georgia by The Georgia Insurance Department, listed in the Department of Treasury's Publication of Companies holding Certificates of Authority as Acceptable Surety on Federal Bonds and as acceptable reinsuring companies. The bid bond, payment bond, and performance bond must have an A.M. Best rating of A-5 or higher. Gwinnett County does not discriminate on the basis of disability in the admission or access to its programs or activities. Any requests for reasonable accommodations required by individuals to fully participate in any open meeting, program or activity of Gwinnett County Government should be directed to the ADA Coordinator at the Gwinnett County Justice and Administration Center, 770-822-8165. The written bid documents supersede any verbal or written prior communications between the parties. Award will be made to the contractor submitting the lowest responsive and responsible bid. Gwinnett County reserves the right to reject any or all bids, to waive technicalities, and to make an award deemed in its best interest. Bids may be split or awarded in entirety. Gwinnett County reserves the option to negotiate terms, conditions and pricing with the lowest responsive, responsible bidder(s) at its discretion. The Gwinnett County Board of Commissioners is soliciting costs for the purchase of United States Army Corps of Engineers (USACE) approved credits to satisfy the stream and wetland mitigation requirements resulting from the Regional 34 Permit associated with Stanley Road Relocation Project in Gwinnett County. According to the 2018 USACE standard operating procedures for mitigation, stream impacts associated with the project will require credits from the Upper Oconee River Watershed (HUC8 03070103). The selected mitigation bank(s) is expected to provide credits approved and released by the USACE in the Upper Oconee River Watershed. No other basins will be considered and submissions for credits in other basins will be deemed non-responsive. An authorized mitigation bank representative should complete and return the attached Bid Schedule signed and dated. Any bid on the stream mitigation credits must be for the entire amount of 5,405 credits. Bids received for less than the entire amount of stream credits will be deemed non-responsive. Any mitigation bank bidding should include the appropriate number of credits available and the corresponding prices. o The current USACE guidelines and preferences regarding mitigation will be considered during the evaluation of bids. o All credits must be available on bid date, March 13, 2025. o Purchase of the credits will be made by Gwinnett County within 90 days after the date bids are received. o The Bid Schedule reflects the number of credits required as submitted to the USACE in the permit application. Should the USACE modify the credit requirements (either up or down), the actual credits purchased from this solicitation will be the approved amount from the USACE. o Permit Number SAS-2024-00833
