Phyllis Glanton, Interim QPA The City of Newark intends to enter into an agreement/contract with a vendor to provide various grades of crushed stone. The City reserves the right to award the contract in part or in whole and for one year and/or two. 4.1 The intent of this contract is not to provide the Contractor with continuous work daily. The work to be performed under this contract shall be on an as-needed basis. The Contractor shall be instructed to use particular equipment for maintenance and repair. The Contractor shall undertake non-emergency work within twenty-four (24) hours from notification by the Engineer. There shall also be times when emergency conditions will exist. During these emergencies, the Contractor shall be prepared to respond within two (2) hours from notification by the Engineer, including nights, Saturdays, Sundays, and Holidays. The Engineer shall be the authorized person who determines when the conditions constitute an emergency.
