Site work, paving and outdoor lighting for a mixed-use development in El Mirage, Arizona. Completed plans call for site work for a library; sidewalk / parking lot; for outdoor lighting for a sidewalk / parking lot; and for paving for a sidewalk / parking lot.

The purpose of this project is to construct an outdoor learning pavilion in the area east of the El Mirage Library located at 13513 North El Mirage Road. Improvements include a ramada, sitting/learning nodes, decomposed granite path, concrete sidewalk, ADA ramp, concrete steps, landscape, irrigation, grading, metal screens, solar light poles, ramada lighting, and electrical work. A portion of this project is funded by the Maricopa County Community Development Block Grant (CDBG). The Offeror shall not contact or ask questions of the department for which the requirement is being procured. The project has a budget of $399,000 for construction. AWARD OF CONTRACT: Unless the Offeror states otherwise, or unless provided within this Invitation to Bid, the City reserves the right to award by individual line item, by group of line items, or as a total, whichever is determined by the City Manager to be most advantageous to the City. The City of El Mirage reserves the right to award based on the bid that presents the City with the best overall value, which may or may not be the lowest bid. 30.23 DETERMINATION OF LOWEST RESPONSIBLE BIDDER - Unless the right of rejection is exercised as provided by 30.23(B)(6)(c) or 30.32(C), the purchase or contract shall be made from and with the lowest responsive and responsible bidder for the entire purchase, contract or for any part thereof. In determining the lowest responsive and responsible bidder, the Council shall consider: 1. The best overall value for the city provided by the bidder; 2. The ability, capacity, and skill of the bidder to perform the contract or provide the service required; 3. The ability of the bidder to perform the contract or provide the services promptly or within the specified time, without delay or interference; 4. The quality of performance of previous contracts; 5. The compliance with previous and existing compliance by the bidder with laws and regulations of the federal, state, and/or city by the bidder; 6. The financial resources and/or ability of the bidder to perform the contract; and/or 7. The quality, availability, and adaptability of the supplies or services. Notwithstanding any other provision of this Invitation to Bid, The City expressly reserves the right to: Waive any immaterial defect or informality: or Reject any or all bids, or portions thereof, or Reissue an Invitation to Bid. A response to an Invitation to Bid is an offer to contract with the City based upon the terms, conditions and specifications contained in the City's Invitation to Bid and the written amendments thereto, if any. Bids do not become contracts unless and until they are accepted and executed by the City Manager and the City Council. A contract is formed when written notice of award(s) is provided to the successful Offeror(s). The contract has its inception in the award document, eliminating a formal signing of a separate contract. For that reason, all of the terms and conditions of the procurement contract are contained in the Invitation to Bid; unless modified by an Amendment. The Bidder shall commence work under this project on or before the fifth (5th) day following the project start date indicated on the "Notice to Proceed" issued by the City of El Mirage and shall fully complete all work under the project within 180 calendar days. The Bidder shall, at all times, during the continuance of the Contract, prosecute the work with such force and equipment as is sufficient to complete all work within the time specified.
