Hma Milling, 3" or Less 15,442 Ton Hot Mix Asphalt 12.5 M 64 Surface Course High Rap 6,752 Ton Hot Mix Asphalt 12.5 M E Surface Course High Rap Pursuant to N.J.S.A. 34:11-56.35(d), if the Commissioner of the Department of Labor and Workforce Development (LWD Commissioner) makes an initial determination that an employer has violated the provisions of P.L.1963, c.150 (C.34:11-56.25 et seq.) by paying wages at rates less than the rates applicable under that act, the LWD Commissioner may immediately issue a stop-work order to cease all business operations at every site where the violation has occurred, and may assess a civil penalty of $5,000 per day against the employer for each day it conducts business operations in violation of the stop-work order. If the stop-work order is issued against a subcontractor, the general contractor may terminate that subcontractor from the project in accordance with N.J.S.A. 34:11-56.35(d). Minimum wage rates for this project shall be as specified in the "Prevailing Wage Determination of the New Jersey Department of Labor and Workforce Development" on file with this Department.
