Bids must be made on standard RFB forms in the manner designated and required by the specifications; enclosed in sealed envelopes bearing the name and address of the bidder, designating the name of the bid on the outside, addressed to the Director of Purchasing. The Contractor will be required to comply with requirements of N.J.S.A. 10:2-1 (Anti Discrimination in Employment), N.J.S.A. 10:5-31 et seq. and N.J.A.C.17:27 et seq. (Equal Employment Opportunity), 42 U.S.C. 12101 et seq. (Americans with Disabilities Act), N.J.S.A. 52:32-44 et seq. and (New Jersey Business Registration). The County of Monmouth reserves the right to reject any or all bids in accordance with applicable laws and regulations. 1. The attached Request for Bid (hereinafter "RFB") must be used and fully completed. 2. A properly completed Non-Collusion Affidavit must be provided at the time of bid. 3. A properly completed Statement of Ownership must be provided at the time of bid. 4. A properly completed Acknowledgement of Receipt of Addenda (if any) must be provided at the time of bid. 5. Bidders must provide the County with a list of parties intended to be utilized as subcontractors (if any). If the bid notice to this RFB indicates a bid guarantee is required, a bid guarantee shall accompany the bid in the amount of 10% of the bid but not in excess of twenty thousand dollars ($20,000.00) and may be supplied at the option of the bidder, by a Certified Check, Cashier's Check or original Bid Bond from a reputable insurance company authorized to post such bonds in the State of New Jersey. This 10% guaranty is mandatory. If the bid notice to this RFB indicates a consent of surety is required, this bid must be accompanied by an original consent of surety in which the surety company agrees to post a Contract Bond for both (a) Performance and (b) Labor and Material Payment, equal to 100% of the contract amount if the contract is awarded to its principal. Exception: In appropriate circumstances, including the procurement of a vehicle(s) or heavy equipment, an original consent of surety to issue a Performance Bond may be provided in lieu of a consent of surety to provide a Contract Bond. The consent of surety may not contain any conditions or reservations, other than the condition that the contract be awarded to the Contractor, and should be substantially in accordance with the attached sample. The Contract Bond or, if appropriate, the Performance Bond will be required after award and prior to the issuance of an executed Contract and Purchase Order. Separate Performance and Labor and Material Payment Bonds may be submitted in lieu of a Contract Bond, so long as each is for 100% of the contract amount. The County may include in any contract, the length of which is for three (3) years or less, the option to renew the contract for either one (1) two-year period, or two (2) one-year periods. Any renewal option shall be exercised by resolution of the Board of County Commissioners upon a finding that the services are being performed in an effective and efficient manner. The decision to exercise (or not exercise) the renewal option(s) will be at the sole discretion of the County. The County reserves the right to reject all bids in accordance with N.J.S.A. 40A:11-13.2.
