Project Name: Harmer Street Bridge Replacement and Resurfacing Project Location: Jefferson County Project Description: The project includes replacement of concrete substructure, superstructure, bridge approach work, guardrails and erosion control at the bridge abutments, utility relocation, and mill and overlay. Construction Cost Estimate: [$1,750,000 - $2,050,000] Question Deadline 05/05/2025 at 5:00 PM CT All bidding questions must be submitted via the project solicitation online. The work shall consist of replacement of concrete substructure, superstructure, bridge approach work, guardrails and erosion control at the bridge abutments, utility relocation, and mill and overlay. Alabama Department of Transportation Standard Specifications for Highway Construction, 2022 Edition and Special Provisions will be used for the project. The entire project shall be completed in 150 working days. Proposals will only be accepted from contractors on the Alabama Department of Transportation's (ALDOT) list of pre-qualified prime contractors. The award of the contract will be made only to a contractor who has a valid certification of qualification from ALDOT as required by state law. The Jefferson County Commission encourages the voluntary utilization of qualified resident Jefferson County contractors, minority contractors, and disadvantaged contractors who live, work, and do business in Jefferson County. The minimum pay to all skilled intermediate and unskilled labor employed on this Contract shall be as set forth in the Special Provisions. Per Alabama Department of Revenue Code 810-6-3.77 "any contractor or subcontractor of any tangible personal property to be incorporated into realty pursuant to a contract entered into on or after January 1, 2014, with a governmental entity is exempt from all state, county, and municipal sales and use taxes." It is the contractor's responsibility to submit all application requirements to the Alabama Department of Revenue and to be informed of any applicable rules and exclusions. Certified check or bid bond for 5 percent of total bid, made payable to the Commission of Jefferson County must accompany each bid as evidence of good faith. The maximum per contract is $10,000 for bids under $500,000 or $50,000 per contract for bids $500,000 or more. The Bid Bond shall be forfeited to Jefferson County, Alabama, as liquidated damages if the BIDDER fails to execute the Contract and provide Performance and Payment Bonds within ten (10) days after being notified of the County's intent to award the Contract. Performance Bond and Payment Bond will be required of the successful BIDDER. Performance Bond must be in the penal amount of 100% of the Contract price and Payment Bond in the penal amount of 100% of the Contract price. Bonds must be executed by a Surety company acceptable to the Commission of Jefferson County, Alabama and authorized to do business in the State of Alabama. The Contractor is hereby advised that the contract is a working day contract and that the contract time limit of one hundred and fifty (150) working days shall be strictly observed. LIQUIDATED DAMAGES WILL BE ASSESSED IF THE CONTRACT TIME IS EXCEEDED. Liquidated damages shall be paid if necessary, based on the Alabama Department of Transportation Standard Specifications for Highway Construction 2022 Edition, Section 108.11. The Contractor may apply for an extension of time; however, such an extension of time must be approved PRIOR to the contract completion date to avoid imposition of liquidated damages. The Contractor shall obtain and pay for all licenses and permits required by the State, County and City authorities having jurisdiction over the work. THE ATTENTION OF ALL BIDDERS IS CALLED TO THE PROVISIONS OF THE STATE LAW GOVERNING GENERAL CONTRACTORS, AS SET FORTH IN ALABAMA CODE SECTIONS 34-8-1 THROUGH SECTION 34-8-28 (1975), AS AMENDED; AND BIDDERS SHALL BE GOVERNED BY SAID LAW INSOFAR AS IT IS APPLICABLE. THE ABOVE MENTIONED PROVISIONS OF THE CODE MAKE IT ILLEGAL FOR THE OWNER TO CONSIDER A BID PROPOSAL FROM ANYONE WHO IS NOT PROPERLY LICENSED UNDER SUCH CODE PROVISIONS. THE ATTENTION OF BIDDERS IS CALLED TO THE PROVISIONS OF ALABAMA CODE SECTION 39-2-14 (1975) AS AMENDED, REQUIRING A NONRESIDENT CONTRACTOR TO REGISTER WITH THE DEPARTMENT OF REVENUE PRIOR TO ENGAGING IN THE PERFORMANCE OF A CONTRACT IN THE STATE OF ALABAMA. THE ATTENTION OF BIDDERS IS CALLED TO THE PROVISIONS OF ALABAMA CODE SECTION 39-3-5 (1975) AS AMENDED, REGARDING PREFERENCE TO RESIDENT CONTRACTORS. Jefferson County may make such investigations as deems necessary to determine the ability of the BIDDER to perform the WORK, and the BIDDER shall furnish to Jefferson County all such information and data for this purpose as Jefferson County may request. Jefferson County reserves the right to reject any BID if the evidence submitted by, or investigation of, such BIDDER fails to satisfy Jefferson County that such bidder is properly qualified to carry out the obligations of the Agreement and to complete the WORK contemplated therein. The Commission of Jefferson County, Alabama hereby notifies all bidders Jefferson County is an equal opportunity employer in accordance with Title VII, Civil Rights Act of 1964, 42 U.S.C. __ 1981, 1983, 1986 and amendments, and it is the policy of Jefferson County to require contractors, vendors and suppliers (hereinafter "Contractor") providing goods and services to the County to afford equal opportunity for employment to all individuals regardless of race, color, sex, age, religion, national origin, disability or veteran status. ACT 2016-312 PROHIBITION AGAINST BOYCOTTING Contractor certifies that it is not currently engaged in, and for the duration of this agreement will not engage in, the boycott of a person or an entity based in or doing business with a jurisdiction with which this state enjoys open trade. STATEMENT OF COMPLIANCE WITH ALABAMA CODE SECTION 31-13-9: By signing this contract, the contracting parties affirm, for the duration of the agreement, that they will not violate federal immigration law or knowingly employ, hire for employment, or continue to employ an unauthorized alien within the State of Alabama. Furthermore, a contracting party found to be in violation of this provision shall be deemed in breach of the agreement and shall be responsible for all damages resulting therefrom. GOVERNING LAW/DISPUTE RESOLUTION The parties agree that this contract is made and entered into in Jefferson County, Alabama and that all services, materials and equipment to be rendered pursuant to said Agreement are to be delivered in Jefferson County, Alabama. The interpretation and enforcement of this Agreement will be governed by the laws of the State of Alabama. The parties agree that jurisdiction and venue over all disputes arising under this Agreement shall be the Circuit Court of Jefferson County, Alabama, Birmingham Division. NON-DISCRIMINATION POLICY The contractor will not discriminate against any employee or applicant for employment because of race, color, religion, sex, national origin, age, disability or veteran status. The Contractor will ensure that qualified applicants are employed, and that employees are treated during employment, without regard to their race, color, religion, sex, national origin, age, disability or veteran status. Such action shall include, but not be limited to the following: employment, promotion, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. The Jefferson County Commission reserves the right to reject any and all bid proposals and to waive all informalities. *The value for this project is based on a financial range. The value is listed as the highest possible cost from the range provided by a stakeholder or official project document.
