Repainting of the Martha Water Tower 14' diameter by 80 feet tall and Replacement of the corrugated Altitude Valve Box with a Concrete Vault, for the Town of Martha in accordance with Drawings, Specifications and other Contract Documents prepared by: Fox, Drechsler & Brickley, Inc. P.O. Box 758, 113 Falcon Rd. Altus, Oklahoma 73522 Each Proposal shall be accompanied by an acceptable form of Proposal Guaranty in an amount equal to at least 5% of the Proposal payable to The Town of Martha as a guaranty that if the Proposal is accepted, the BIDDER will execute the Contract and file acceptable Performance and Statutory Bonds within 10 days after the award of the Contract. The Town of Martha hereinafter called the OWNER, reserves the right to reject any or all Proposals and to waive any formality or technicality in any Proposal in the interest of the OWNER. The Contract will be awarded to the lowest and/or best qualified responsible BIDDER complying with these instructions and with the Advertisement. The OWNER reserves the right to reject any or all Proposals or to waive any formality or technicality in any Proposal in the interest of the OWNER. No BIDDER may withdraw his Proposal for a period of 30 days after the date of opening thereof. If any person contemplating submitting a Proposal is in doubt as to the true meaning of any part of the Drawings, Specifications or other Contract Documents, or finds discrepancies in or omissions from the Drawings or Specifications, that person may submit to the ENGINEER a written request for an interpretation or correction thereof. The person submitting the request will be responsible for its prompt delivery. Any interpretation or correction of the documents will be made only by Addendum duly issued and a copy of the Addendum will be mailed or delivered to each person receiving a set of the Contract Documents. Neither the OWNER nor the ENGINEER will be responsible for any other explanations or interpretations of the Contract Documents. Each Proposal shall be accompanied by a Certified Check or Bid Bond, in an amount equal to 5% of the Proposal, payable without condition to the OWNER as a guaranty that the BIDDER, if awarded the Contract, will promptly execute the Agreement in accordance with the Proposal and the other Contract Documents, and will furnish good and sufficient Bond for the faithful performance of the same, and for the payment to all persons supplying labor and material for the work. The Proposal Guaranties of all BIDDERS except the three lowest will be returned promptly after the canvass of Proposals. Bid Bonds shall be secured from a Surety Company listed in the Federal Registry, Department of the Treasury, Fiscal Service Listing. The successful BIDDER, simultaneously with the execution of the Contract, will be required to furnish a faithful Performance Bond in an amount equal to 100% of the Contract Amount and a Statutory Bond made payable to CLIENT equal to 100% of the Contract Amount; said Bonds shall be secured from a Surety Company listed in the Federal Registry, Department of the Treasurer, Fiscal Service Listing Liquidated damages for failure to complete the work within the time specified shall be assessed at the rate of $250.00 per day for each additional calendar day until the work is completed. *The bid list for this project may be incomplete.
