The City ofFall River reserves the right to waive any informalities or irregularities in the submission received. The City of Fall River reserves the right to reject any/all proposals when deemed in the best interest of the City of Fall River. The City off all River shall be the solejudge of equivalency and acceptability. Bids are subject to M.G.L. Chapter 30-Section 39M and to Massachusetts Prevailing Wage Rates as required by M.G.L. Chapter 149- Sections 26 to 27H inclusive. MBE/WBE Businesses are encouraged to participate. This project has a 5% goal and applicable compliance forms must be submitted with each bid. Each bid must include a bid deposit equal to five percent (5%) of the total amount of the bid considering all alternates. The bid deposit may be in the form of cash, certified check, bank treasurers of cashier's check, or a bid bond from a responsible surety company licensed to do business in the state of Massachusetts. In accordance with the requirements of M.G.L. c. 30, sec. 38A, this contract contains MassDOT Highway Division price adjustments for diesel fuel, gasoline, liquid asphalt, Portland cement concrete, structural steel and reinforcing steel. All calculations shall be according to MassDOT special provisions and procedures. The period price posted on the MassDOT website forthe month of May 2025 of $635/ton forliquid asphalt, $TBD/gallon for diesel, $TBD/gallon for gasoline, and $425.53/ton for Portland cement and $TBD/ton forstructural/reinforcing steel are the base prices forthis contract. The roadway work includes excavation, pavement milling, paving with HMA, concrete sidewalks and wheelchair ramps, r/r cement pavers, granite curb, traffic signs, pavement markings and line striping.
