The OWNER also reserves the right to waive irregularities and technicalities and to re-advertise for additional bids. If the winning bid exceeds the OWNER funds for the project, the OWNER reserves the right to reduce the project length by adjusting the beginning project station. The OWNER reserves the right to reject all bids, terminate the process, or re-advertise and solicit new or additional bids. The OWNER reserves the right to retain all bids submitted and to use any ideas in a proposal regardless of whether that bid is selected. By submitting a bid, each bidder recognizes and agrees that the OWNER may reject its bid based upon the OWNERS exercise of its sole discretion. Every bidder waives any claims it may have for damages or other relief resulting directly or indirectly from the rejection of its bid based upon any ground whatsoever, including the OWNERS exercise of its sole discretion and the OWNERS disclosure of or refusal to disclose any pertinent information related to the reasons for the OWNERS rejection of said bid.
