The Project generally includes supplying, delivering, and mixing ambient mix asphalt ("AMA"), and providing a paver machine for County's use in paving certain parts of Trough Road, as further described in Exhibits A, B, and B-1 in the bid documents. No bids will be considered which are received after the date and time set forth above and any bids received after such date and time shall be returned to the bidder and will not be considered under any circumstances. Sole responsibility rests with the bidder to ensure that their bid is received on time at the stated Location. The Successful Bidder, as defined in the Instructions to Bidders, will be required to furnish certification of specific insurance requirements and payment and performance bonds required for contracts with Eagle County prior to the commencement of any work. The agreement will be awarded to the lowest, qualified, responsible bidder to whom Eagle County, on the basis of its evaluation as set forth in the bid documents, makes an award. Notwithstanding the foregoing, Eagle County reserves the right, in its sole discretion, to accept or reject any and all bids, to waive any informality or technicality in any bid, to negotiate contract terms with a bidder, to disregard all non-conforming, non-responsive or conditional bids and to postpone the award of the project agreement for a period not exceeding thirty-one (31) days after the bid opening.
