East Allen County Schools (the "Owner") and Weig and Construction Co., Inc.(Construction Manager or the CMc), 7808 Honeywell Drive, Fort Wayne, Indiana 46825,have entered into a contract pursuant to which Weig and Construction will be providing all of the Construction Manager as Constructor services in connection with Leo High School Athletic Fieldhouse Addition. Accordingly, Weigand Construction will be receiving sealed bids from pre-qualifiedcontractors, as determined by Weig and Construction in its sole and complete discretion,for the work and supply of materials for the Leo High SchoolAthletic Fieldhouse Addition -Bid Phase 2: Concrete andSteel. (the "Project"). Each bid shall include withsuch bid, a certified check orbid bond made payable to Weigand Construction Co., Inc.for an amount not less than fivepercent (5%) of the maximumbid. Should a successful bidder withdraw its bid or fail toexecute a satisfactory sub-contract with the CMc, Weigt and Construction may then declarethe bid deposit or bid bond tobe forfeited as liquidated damages. Each successful bidder shallenter into a sub-contract and/orpurchase order with WeigandConstruction. (See section 0052 00 of the Project Manual.) Each successful bidder may berequired to furnish Performance & Payment Bonds (if Alternate Bid regarding Bonds isaccepted) which cover faithfulperformance of the contractand the payment of all obligations arising thereunder (if Alternate Bid regarding Performance Bond is accepted, it willbe made out to Weigand Construction Co., Inc.). Said bondsshall remain in full force and effect for one year from the substantial completion of the work. A bidder's ability to providesaid bonds is a conditionprecedent to bidding the Project, and any bid submittedwithout an alternate cost forproviding said bonds may bedetermined as non-responsiveby Weigand Construction, in itssole and complete discretion,and rejected by Weigand Construction. The contract will be awarded tothe lowest responsive and responsible bidder complyingwith the conditions for bidding,provided the bid is reasonableand it is to the best interest ofWeigand Construction and theOwner.
