The City of Brooklyn, Ohio ("Owner") is seeking Statements of Qualifications from firms to provide construction manager at risk services for the construction of the proposed Recreation Facility Improvements ("Project") located in the City of Brooklyn, Ohio. July 18, 2025 Short listed firms notified Scope of Work The scope of work is to include CM services, to complete the construction of the Natatorium, recreation facility entrance and office space for the recreation staff. The CM is to anticipate that this is to be an "open-book" contract, the City of Brooklyn, all design professionals and the Owner's Representatives are to have access to the full budget, including the CM and subcontractors costs. Services shall include: Pre-Construction scope will involve working cooperatively with the design professionals to provide, among other services, cost estimating, scheduling, budgeting, value engineering, drawing review for budget and constructability and pre-construction planning throughout the pre-construction phase. Construction Manager shall deliver detailed cost estimates and meet with the team for each of the percent completion when the documents are 30%, 60%, 90% complete and when the construction documents are presented for final review, or as otherwise agreed to by the parties. When the construction documents prepared by the design team are at a stage of completion specified in the CM Agreement, such partially completed documents ("GMP Documents") shall be provided to the CM, together with a draft of the design team's detailed listing of any material incomplete design elements and a statement of intended scope with respect to such incomplete elements ("Prose Statement"). The CM shall then submit to the Owner and the design team its proposed guaranteed maximum price ("GMP") and guaranteed completion date ("GCD"). The CM, Owner and design team shall meet to reconcile any questions, discrepancies or disagreements relating to the GMP qualifications and assumptions, the GMP Documents or the Prose Statement. The reconciliation shall be documented by an addendum to the GMP qualifications and assumptions and shall be approved in writing by the Owner, the Design Team, and the CM. CM shall then submit to Owner, for Owner's approval, the proposed final GMP and GCD based upon the GMP Documents, the approved GMP qualifications and assumptions, and the Prose Statement. Contingent upon the Owner's approval of the final GMP and GCD, the parties will enter into a GMP 3 | P a g e B r o o k l y n R e c r e a t i o n F a c i l i t y R F Q Amendment to the CM Agreement. The final negotiated GMP will not exceed the Project budget for construction and the GCD will be mutually agreed upon. If the proposed GMP exceeds the Project budget or the Owner and CM cannot agree upon a GCD, then Owner may terminate the CM Agreement and seek bids for completion of the Project from other firms. The parties will engage in an "open book" process in which Owner, Design Team and CM will review bids for trade work, the costs proposed for general conditions/overhead of CM, the fee of the CM, and in which the Owner shall have access to all books, records, documents, and other data in CM's possession related to itself, its subcontractors and material suppliers pertaining to bidding, pricing, or performance of the agreement. All work shall be bid, except as expressly approved by Owner for self performance. The CM will provide a list of proposed bidders for the various "bid packages" for the Project to the Owner and to the Design Team for approval and the GMP will be reduced if actual bids are less than the line items provided in the GMP by the amount of the savings. Construction Phase Services. CM shall construct the Project pursuant to the construction documents and in accordance with the Owner's schedule requirements, including the GCD. CM shall select subcontractors based on competitive pricing criteria submitted by prequalified subcontractors in accordance with criteria approved by the Owner. CM shall hold all subcontracts and shall be fully responsible for the means and methods of construction, project safety, project completion within the schedule agreed upon in the preconstruction phase, and prevailing wage requirements and submitting monthly reports to Owner. Project Close Out. Once the work is substantially complete and all "punch list" items have been completed, the CM will coordinate the operational training meetings with the Owner's personnel regarding equipment and processes for the building. The CM will provide Operation and Maintenance manuals in accordance with the contract documents.
