Morton Culinox 999, Food Grade Salt is high purity, food grade granulated sodium chloride produced in vacuum pans from chemically purified brine. The crystals are cubic in structure. Brine treatment, crystallizing technique, and postcrystallizing washing substantially reduce calcium, magnesium, iron, copper and other heavy metals, sulfate and carbonate impurities. High purity helps assure consistent saltiness intensity, and there are stringent standards on visible, insoluble extraneous material. There are no additives. A bid bond and performance bond shall not be required. Liquidated Damages. The seller recognizes and agrees that time is of the essence under this agreement and, due to the speculative character and difficulty of ascertaining damages to the Department of Water resulting from any delay beyond controversy and dispute, will agree that the seller shall pay to the Department of Water the sum of ONE HUNDRED AND NO/100 DOLLARS ($100.00) as liquidated damages and not as a penalty for each day that furnishing and delivery of the material contemplated in this agreement remains uncompleted beyond the time set herein for completion; provided, however, that the remedy of liquidated damages shall be in addition to any other rights and remedies otherwise available to the Department of Water Supply and not expressly waived herein. The Director reserves the righta. to accept or reject any or all offers and to waive any minor inadvertent discrepancy in the bid documents; or b. to withhold award of contract for a period of sixty (60) calendar days from the date of bid opening; and C. to increase or decrease the quantity any time prior to award, and the vendor agrees not to claim loss of profit from this change.
