Furnishing of Labor and Equipment to Trim and Maintain Palm Trees within Various County of Maui Parks and Right of Ways BID/OFFER FORM MUST BE DOWNLOADED, FILLED OUT, SIGNED, AND UPLOADED WITH YOUR BID SUBMISSION. Bidders are required to comply with the newest procurement code, HRS, Chapter 103-D, any rules and regulations and policy directives issued with respect to Chapter 103-D and any amendments thereof. License - Contractor must be a State Licensed Tree Trimmer in good standing. Contactor must have a current Contractors License type 27 or 27B. Insurance - During the term of this Contract, CONTRACTOR shall maintain at all times or cause to be maintained general and professional liability insurance coverage for CONTRACTOR and its employees rendering services to the COUNTY under this Contract. The insurance policies shall be issued by a company or companies authorized to do business in Hawaii and approved by the COUNTY, with combined single limits of not less than ONE MILLION DOLLARS ($1,000,000) per occurrence and TWO MILLION DOLLARS ($2,000,000) in the aggregate for Contracts with a total certified amount of $1,000,000 or less, and THREE MILLION DOLLARS ($3,000,000) in the aggregate for Contracts with a total certified amount of $1,000,001 or more, or such greater amount as may be required from time to time by the COUNTY. Prices submitted should include all taxes, cutting, controlled felling, bucking costs and equipment as specified within this Contract work. Loading and hauling of debris from trimming will be done by the Contractor daily. No debris from trimming will be allowed to remain on park site. A contract shall be awarded to the lowest responsible and responsive bidder for each designated section, provided first cycle of the Scope of Work can be completed within ninety (90) calendar days from the Official Commencement Date as specified in the "Notice to Proceed" issued by the Director of Parks and Recreation. The Scope of Work listed in the Contract Specifications details the required cycles of trimming for each specified palm. With certificates of insurance evidencing the foregoing coverage and provisions. The COUNTY reserves the right to request and receive a certified copy of the policies. CONTRACTOR shall also carry workers' compensation insurance for CONTRACTOR'S employees in the amounts required by applicable law. Failure to maintain the necessary insurance in accordance with the provisions set forth herein shall constitute a material breach of this Contract and the COUNTY shall thereafter have the options of pursing remedies for such breach and/or immediate termination of this Contract. It is mutually understood and agreed by and between the parties to the contract that time shall be of the essence of the contract and that in case of failure on the part of the contractor to complete his contract within the time specified and agreed upon, the County will be damaged thereby, and the amount of said damages, being difficult if not impossible of definite ascertainment and proof, it is hereby agreed that the amount of such damages shall be estimated, agreed upon, liquidated and fixed at the sum of Two Hundred Sixty & No/100 Dollars ($260.00) for each and every calendar day, including Saturdays, Sundays and holidays, the contractor shall delay in the completion of his contract; and the contractor hereby agrees to pay the County as liquidated damages, and not by way of penalty, such total sum as shall be due for such delay, computed as aforesaid.
