The Project Will Also Include Replacement of Various Curb Ramp This Work Shall Be Performed by an Odot Pre-qualified Contractor and in Accordance With Plans,specifications and Other Contract Documents. Prequalification Status Must Be in Effect at the Time of Bidding, the Time of Sale, the Time of Award and Through the Life of the Construction Contract. Proposals Must Be Submitted on the Form Furnished by the City; Must Contain the Full Name of Every Person Interested Therein and Shall Be Accompanied by a Bid Guarantee of a Bond as Required in Section 153.54 (a) of the Ohio Revised Code With a Satisfactory Surety or Accompanied by a Bid Guarantee of Not Less Than Ten (10%) Per Cent of the Amount of the Proposal by a Certified Check, Cashiers Check or Letter of Credit Pursuant to Chapter 1305 and Section 153.54 of the Ohio Revised Code on a Solvent Bank, Subject to the Conditions Provided in the Notice to Bidders. The Successful Bidder Will Be Required to Furnish a Satisfactory Performance Bond. Odot Shall Be Named as an Obligee Along With the City of Defiance on the Performance Bond. Furnish Steel and Iron Products That Are Made in the United States According to the Applicable Provisions of Federal Regulations Stated in 23 Cfr 635.410, State of Ohio Laws and Orc 153.011 and 5525.21. "United States" Means the United States of America and Includes All Territory, Continental or Insular, Subject to the Jurisdiction of the United States. Both the State and Federal Requirements Contained Within the Odot Contract Provisions Apply to This Contract. After the Award of the Contract and Prior to the Time the Contract is Entered in to, Bidders Shall Submit the Affidavit Required Under Orc 5719.042 That the Bidder Was Not Charged With Any Delinquent Personal Property Taxes in Defiance County, Ohio. Attention of Bidders is Particularly Called to the Requirements as to Condition of Employment to Be Observed and Minimum Wage Rates to Be Paid Under the Contract. The Successful Bidder Will Be Required to Pay Davis Bacon Wage Rates and Conform to All Provisions of the Federal Davis Bacon and Related Acts Which Requires That All Laborers and Mechanics Employed by Contractors and Subcontractors Performing on Federal Contracts (and Contractors and Subcontractors Performing on Federally Assisted Contracts Under the Related Acts) in Excess of $2,000 Pay Their Laborers and Mechanics Not Less Than the Prevailing Wage Rates and Fringe Benefits, as Determined by the Secretary of Labor for Corresponding Classes of Laborers and Mechanics Employed on Similar Projects in the Area. Disadvantaged Business Enterprise (Dbe) Participation Goals (Subcontracts, Materials, Supplies) Have Been Set on This Project for Those Certified as Dbes Pursuant to Title 23, U.s.c. Section 140(C) and 49 Cfr, Part 26, and Where Applicable Qualified to Bid With Odot Under Chapter 5525 of the Orc. Because There is a Dbe Goal on This Project, All Bidders Are Required to Submit to Odot Their Dbe Utilization Plan Prior to or at the Time of Bid. Any Bids Received Without Electronic Submission of the Dbe Utilization Plan to Odot at or Before Bid Time, Will Be Deemed Unresponsive. Furthermore, the Apparent Low Bidder Needs to Supply a Dbe Affirmation Form to Odot Within Five Calendar Days of the Bid Opening. The Dbe Affirmation Shall Be Approved by Odot Prior to the City Awarding the Contract. Any Bid May Be Withdrawn Prior to the Scheduled Closing Time for Receipt of Bids, but No Bidder Shall Withdraw His Bid Within Sixty (60) Days After the Actual Opening Thereof.
