Bids shall be submitted on the blank Bid Form furnished with the specifications and must be accompanied by a bid security in the form of a Certified Check, Cashier's Check or acceptable Bid Bond, payable to Mississippi Gulf Coast Community College, in the amount equal to at least five percent (5%) of the base bid; such security to be forfeited as liquidated damages, not penalty, by any bidder who may be awarded the contract but who fails to carry out the terms of the proposal, execute the contract and post a performance bond in the form and amount within the time specified. The Owner expressly reserves the right to accept or reject any or all bids or any part of any or all bids based on a lowest and best bid determination. Mississippi Gulf Coast Community College reserves the right to reject any or all bids on any or all projects and to waive any formalities. All bids submitted in excess of $50,000.00 by a prime or subcontractor to do any erection, building, construction, repair, maintenance or related work, must comply with Section 31-3-21, Mississippi Code of 1972, by having a current Certificate of Responsibility from the State Board of Public Contractors. The current Certificate of Responsibility Number shall be indicated on the exterior of the sealed bid envelope before it can be opened. If the bid is not in excess of $50,000.00, "THIS BID SHALL NOT EXCEED $50,000.00", shall be indicated on the sealed bid envelope before it can be opened.
