Fsst fourplexes flandreau santee sioux tribe flandreau, south dakota Each bid that exceeds $5,000 must contain a Certified Check, a Cashier's Check or Draft for five percent (5%) of the amount of the bid, (including "add" alternates), such Check or Draft to be certified or issued by either a State or National Bank, and payable to the Owner, or, in lieu thereof, a Bid Bond for ten percent (10%) of the amount of the bid, such Bond to be issued by a surety authorized to do business in this state and payable to the Owner. Said Certified Check, Cashier's Check, Draft or Bid Bond guarantees the execution of a contract and shall be held by the Owner until said contract is executed. The successful bidder shall be required to provide a contract performance bond and a payment bond in the penal amount of one hundred percent (100%) of the contract price in a form approved by the City, dated and executed the same date as the contract documents to comply with statutory requirements, in accordance with SDCL 5-21. Time is an essential element of the contract. It is important that the work be pressed vigorously to completion. The cost to the Owner of the administration of the Contract, including architectural, engineering, inspection, and supervision, will be increased as the time occupied in the work is lengthened. Should the Contractor fail to substantially complete the work within the time set forth herein or within such extra time as may have been allowed by increases in the contract time or by formally approved extensions granted by the Owner, the Contractor and the Contractor's surety shall be liable for and shall pay the Owner $100.00 per calendar day as liquidated damages for each calendar day of delay until the work is substantially complete. Permitting the Contractor to continue and complete the work covered by the terms of the contract after the expiration of the working time provided for therein and inclusive of any extensions granted, shall in no way be construed as a waiver by the Owner of its rights under the contract. All proposals shall be submitted on blanks provided by the Architect. Proposals with deviations or reservations from the full contract as called for, or not having all blanks filled in shall be considered informal and subject to rejection at the discretion of the Owner. Contractor must acknowledge receipt of Addenda on his proposal or his proposal may be rejected.
