SEALED BIDS ARE BEING ACCEPTED by the City of Abingdon for the letting of a contract for the removal from the COA dump site of trees, branches, yard waste, and related items for the controlled burning on the property of Contractor. The specific terms of the contract are as follows: Taxes. Contractor acknowledges that it is an inde-pendent contractor, and therefore, no payroll taxes of any kind shall be withheld from payments to Contractor or paid by COA on behalf of Contractor or any assistants or employees of Contractor. Contractor shall not be treated as an employee, with respect to the services performed hereunder, for federal or state income tax purposes. Contractor shall be furnished, on a timely basis, with an IRS form 1099. Contractor understands that it is Contractor's responsibility to pay, according to applicable law, Contractor's own income taxes. Employment of Assistants. Contractor may, at Contractor's own expense, employ any employees and/or assistants that Contractor deems necessary to perform Contractor's obligations under the terms of this agreement. COA shall not exercise control, di-rection, or supervision over such employees and/or assistants. Insurance. Contractor shall be solely responsible for all of Contractor's own insurance and shall at all times maintain such types and amounts of insurance, including health and medical insurance, auto-mobile/liability insurance) reasonably necessary to ful fill its obligations under the Agreement. Contract-tor acknowledges that COA is under no obligation to provide any worker's compensation insurance and that Contractor shall comply with worker's compensation laws. Contractor will provide, upon request, proof of such insurance to COA. Indemnification. Contractor agrees to assume the risk, waive, hold harmless and indemnify COA from and against any claim of liability and/or damage, or any nature, which anyone may have or suffer as a result Contractor, his assistants, or employees in the performance of the services, and agrees to indemnify COA from expenses COA may incur or become obligated to pay, such as attorney's fees, court costs, direct out of pocket expenses incurred, in defending any claim of Contractor, his assistants, employees or 3rd parties for injury, pain and suffering, economic loss/damages or otherwise against COA and arising out of the services provided by Contractor. Bids are to be sealed and must be received in the office of the City Clerk, 114 E. Meek St., Abingdon, Illinois, by July 21, 2025, at 4:30 p.m. All bids will be opened and considered on July 21, 2025, at during the regular meeting of the City Council of Abingdon. No more than 1 bid per person, or business entity, will be considered. The City of Abingdon reserves the right to accept or reject any or all bids.
