The project will consist of the following approximate quantities: 170 SY Pavement Removal, 110 Tons Hot Mix Asphalt paving, 6 inch watermain, 6 inch gate valves. The bid shall be accompanied by a Bidderís Bond in a separate envelope in the amount of five percent (5%) of the full amount of the bid, executed by the Bidder as Principal and by a Surety Company authorized to do business in North Dakota. If the Principalís bid is accepted by the OWNER and the contract awarded, the principal, within ten (10) days after the Notice of Award, will be required to execute and effect a contract in accordance with the terms of the principalís bid and any requirements and conditions of the OWNER. If any person contemplating submitting a Proposal is in doubt as to the true meaning of any part of the Drawings, Specifications, or other Contract Documents, or finds discrepancies in or omissions from the Drawings or Specifications, he may submit to the ENGINEER a written request for an interpretation or correction thereof. The person submitting the request will be responsible for its prompt delivery. Any interpretation or correction of the documents will be made only by Addendum duly issued and a copy of the Addendum will be mailed or delivered to each person receiving a set of the Contract Documents The work on the improvements is to commence upon a date to be specified by the OWNER, notice of which will be given to the successful bidder ten (10) days in advance of the start of construction. The Contractor will be required to commence construction, and in an approved sequence, complete the project by October 31, 2025. Bid and Bid Bond must be executed by a principal. Signatures by other than a president, vice president, or CEO, must be accompanied by sufficient evidence (duly executed meeting minutes, resolution, power of attorney,) to indicate that the signatory has the authority to bind the company or organization. A Contractor's Bond, as required by Section 48-01.2-10 of the North Dakota Century Code, shall be included with the executed Contract Documents. The Bid Security shall be as required in Section 48-01.2-05 of the North Dakota Century Code. The OWNER retains the right to reject any or all of the bids submitted and to waive any informality in any bid and to hold all bids for a period not to exceed thirty (30) days from said date of opening and to hold the three low bids and bid securities for a period not to exceed sixty (60) days from said date of bid opening.
