Criteria used for the evaluation may include cost, previous performance and references, responsiveness to specifications, and years of experience of the company or personnel. The awarding authority's determination and selection shall be final. The City of Carlsbad reserves the right to reject any or all bids or any part of the bid, to waive minor defects or technicalities, or to solicit new bids. The City of Carlsbad reserves the right to retain all bids and to use any ideas in a submittal regardless of whether that submittal is selected. By submitting a bid, the firm is providing a guarantee to the city that, if chosen, they will be able to provide the proposed supplies and services during the period of time discussed in this RFB. There is no expressed or implied obligation for the city to reimburse responding firms for any expenses incurred in preparing submittals in response to this request. Submittals (including accompanying materials) will become the property of the city. Submittals will be held in confidence to the extent permitted by law. After award of a contract or after rejection of all submittals, the submittal will be public records subject to disclosure under the California Public Records Act (Government Code Section 6250 et seq.).
