Each bid shall be accompanied by a certified check, cashier's check or bid bond payable to the City Treasurer of the City of New Brunswick, as a guarantee that if the contract is awarded to the bidder, the bidder will enter into a contract therefore. The amount so deposited shall be ten percent (10%) of the bid, but in no case in excess of $20,000.00. N.J.S.A. 40A11-14, provides that the Governing Body of any municipality may provide the form and manner of approval of all guarantee, indemnity, fidelity or other bonds required. Bidders must comply with P.L.1963 Chapter 150 (Prevailing Wage), P.L.1975 Chapter 127, N.J.A.C. 17:27, N.J.S.A. 10:5-31 et seq., P.L. 1977 Chapter 33 and with P.L. 1999 Chapter 238. In addition, all bidders must comply with the Public Works Contractor Registration Act - N.J.S.A. 34:11-56.48 et seq., when applicable and comply with the Contractor Responsibility Certification and respond to the Disclosure of Investment Activities in Iran form. According to 40A:11-23, the City is prohibited from receiving bids on Mondays or any day directly following a State or Federal Holiday. Prevailing wages established under the Davis-Bacon Act will apply to this contract. The contract documents contain requirements addressing prevailing labor wage rates, labor standards, nondiscrimination in hiring practices, goals for minority and female participation, MBE and WBE participation, participation by Section 3 residents and businesses, and related matters. The provisions of the Federal Government Department of Labor's current wage rate determinations and the State's Prevailing Wage Act are requirements of this project. The higher of the Federal or State Wage Rate and the higher of the Federal or State Fringe Benefit Rate shall prevail.
