The Red Cliff Band of Lake Superior Chippewa Indians (Tribe) is seeking bid proposals for Eleven (11) Tribal land lease site Phase I Environmental Site Assessments within Gaa Miskwaabikaang (Red Cliff) Reservation in Bayfield County, WI. 1. Project Description Red Cliff is seeking to contract with a Contractor to further evaluate the designated areas and ascertain whether a contaminant release has occurred, identify or confirm what types of contamination are present within the soil and/or groundwater, determine if the waste has a potential to be classified as "hazardous waste", and evaluate redevelopment of the area. Each land lease is 1.25 acres in size. This RFP is intended to source a Contractor with sufficient experience, capacity and resources to service the project under one contract. 4. Equipment, Insurance and Subcontracting Contractor will be responsible for their own personnel, equipment, transportation, fuel, and all other necessary provisions to successfully complete the services outlined in this RFP. Contractor must agree to retain their own insurance and provide Red Cliff with copies of insurance certificates while under contract with the Tribe. The Tribe reserves the right to review all insurance certificates pertaining to this solicitation to guarantee that proper coverage has been acquired. Please see attached 'Contractor Insurance Requirement Checklist' for insurance requirements. Red Cliff assumes no responsibility for accidents, injuries, or damages to property associated with services being provided under contract. The Contractor may not enter into subcontracts for the work other than those approved in the contract with the Tribe. Contractor should identify work to be performed by subcontractors in Contractor's proposal. The Contractor will be solely responsible for payment of its subcontractors and any claims of subcontractors for any failure of the Contractor or any of its other subcontractors to meet the performance schedule or performance specifications for the Project in a timely and professional manner. The Contractor will be fully responsible for any default by a subcontractor, just as if the Contractor itself had defaulted. Each subcontractor must have a written agreement with the Contractor. The agreement must pass through to the subcontractor all provisions of the Contractor's contract with the Tribe that apply to subcontractors. Should the Contractor fail to pass through any provisions of this Contract to one of its subcontractors and the failure damages the Tribe in any way, the Contractor will indemnify the Tribe for the damage. 5. Right to Reject Proposals The Tribe reserves the right to select the proposal(s) deemed to best meet the requirement, which may not necessarily be the lowest cost proposal(s) and reserves the right to reject any or all proposals at any time during the evaluation process. 6. Evaluation Criteria All proposals will be evaluated according to the following criteria: o The Bidder's price for this project o The Bidder's professional qualifications and experience of satisfactory performance of construction services. 7. Native Preference In the case of equally qualified candidates, Indian preference shall be applied to native-owned businesses, but all qualified submittals shall be considered. 8. Requirements a) Provide a detailed fee for labor, and materials. b) Provide available timeline for project completion. c) Provide a principal contact who can be reached for additional information or correspondence as necessary during the RFP evaluation process. d) Tribal law provides that all construction-related contracts for professional services with the Tribe are subject to 5% tax on the contract price pursuant to Chapter 16.8.7 in the Red Cliff Code of Laws unless proof of exemption is provided.
