The undersigned further agrees that if the substantial completion of the work be delayed beyond the time so specified for such completion, the City may retain from the monies which are, or which may become, due to the Contractor the sum of Three Hundred Dollars ($300.00) for each and every day the completion of the work is delayed beyond the time so stipulated herein; and that such amount so to be retained is mutually agreed to be liquidated damages accruing to the City because of such delay, not as a forfeit or penalty, but because the actual loss to the City and to the public caused by the delay in completion will be impractical and extremely difficult to ascertain and determine. The undersigned hereby certifies that no person interested in this proposal is directly or indirectly interested in or connected with any other bid or proposal for said work, and no member of the Council, or any other officer of the City is directly or indirectly interested therein or in any portion thereof. The proposed work under this Contract consists of replacing an existing 36" culvert pipe, installation of 4 new catch basins, 173 lineal feet of 12" and 18" storm conduit, constructing 64 lineal feet of combination curb and gutter with underdrains, replacing a guardrail, excavating 633 lineal feet of swale at City Park, replacing a sanitary lamp hole with a manhole, fire hydrant replacement, and pavement restoration. The estimated cost for this project is $104,000 and $142,255 with alternate items. *The value for this project is based on a financial range.
