Founded in 1993, South Texas College is accredited by the Commission on Colleges of the Southern Association of Colleges and Schools and offers more than 130 degree & Certificate options, including associate degrees in a variety of liberal art, social science, business, math, science, technology, advanced manufacturing and allied health fields of study. Additionally, South Texas College is the only community college in the State of Texas to offer five baccalaureate degrees. South Texas College has a faculty and staff of more than 2,200 to serve 28,000 students, on the college's five campuses, one higher education center, and one virtual campus. The Agreement for the project will be the Standard Form of Agreement between STC and the Contractor. Copies of the Contract Documents are attached here to. Responses to inquiries that directly affect an interpretation or change to this RFP will be issued in writing by addendum (amendment) and sent to all parties recorded by STC as having received a copy of the RFP. All such addenda issued by STC prior to the time that proposals are received shall be considered part of the RFP, and the Respondent shall acknowledge receipt of such in their response. Only those STC replies to inquiries made by formal written addenda shall be binding. Oral and other interpretations or clarifications will be without legal effect. Liquidated Damages. Time is of the essence in the performance by the Contractor under this agreement. In the event that the Contractor shall fail to achieve substantial completion of the work on the project by the Substantial Completion Date, the Contractor shall be liable to pay the Owner liquidated damages in the amount of $ 100.00 per day for each day that the Substantial Completion Date exceeds the date stated in the Contract for Construction. The Contractor authorizes the Owner to deduct such liquidated damages amount from any monies due to the Contractor under this Agreement, if any. The Owner shall have the right to recover any unpaid liquidated damages from the Contractor. Respondent must submit a bid bond or certified check equal to 5% of the total price proposal amount. A Payment Bond is not required on contracts of $25,000.00 or less. A Performance Bond is not required on contracts Orders of $100,000.00 or less. If the total contract price exceeds $25,000.00, the Contractor shall execute in accordance with the provisions of Chapter 2253, Texas Government Code, a Payment Bond in the amount equal to the total contract amount, solely for the protection of those supplying labor, materials and/or equipment in the prosecution of the subject contract. If the total contract price exceeds $100,000, the Contractor shall execute in accordance with the provisions of said Chapter 2253, Texas Government Code, a Performance Bond in the amount of the total contract price conditioned upon the faithful performance of the contract. STC reserves the right to award a Contract for all or any portion of the requirements proposed by reason of this request, or to reject any and all proposals if deemed to be in the best interests of STC and to re-solicit for proposals, or to reject any and all proposals if deemed to be in the best interests of STC and to temporarily or permanently abandon the procurement. If the STC awards a contract, it will award the contract to the offeror(s) whose proposal is the most advantageous to STC and offers the best value, considering price and the evaluation factors set forth in this RFP.
