Coastal Bend College, (hereafter sometimes called the "College" or the "Owner") is soliciting Competitive Cost Proposals for the construction of the "CBC -Jaure -Latcham Buildings - HVAC Upgrades" located in Beeville, Texas, pursuant to the provisions of the Texas Government Code Chapter 2269, Subchapter D, as amended. The base project scope of work consists of providing new mechanical air-handling equipment and all related electrical, mechanical and plumbing work. The general construction shall be performed in strict conformity with the Contract Documents, including the Drawings and Specifications. In the event of a difference in written words and figures in the Bid, the amount in written words shall govern. Throughout the course of the Work (while work is being performed), the Contractor will maintain a qualified Superintendent or foreman at the project site at least 40 hours per week, every day, Monday through Friday, who will have full authority to act for the company represented. His responsibilities will include keeping up to date as built drawings, notifying the Architect of any on-site problems or conflicts, receiving and unloading any material deliveries at the site. A single individual will maintain these duties throughout the course of the work, unless the Architect and Owner are previously notified. Owner will first attempt to negotiate a contract with the selected bidder. Owner and its Project Architect may discuss with the selected bidder options for a scope or time modification and any price change associated with the modification. This procurement, any award, and the resulting contract, if any, is subject to approval by the Owner. If Owner is unable to negotiate a satisfactory contract with the selected bidder, Owner will, formally and in writing, end negotiations with that bidder and proceed to the next bidder in the order of the selection ranking until either a contract is reached or all proposals are rejected. Bidders are advised that Coastal Bend College reserves the right to add additional minor repair, remediation and remodeling projects to the scope ofwork during the course ofthe building program. Such work may or may not affect the specific work identified in the plans and specifications available at the time ofbid submission. Any additional work will be added by Change Order mutually acceptable to the College and the Contractor. Event bid description: Two (2) copies of the Competitive Sealed Cost Proposal will be accepted by the Chief Financial Officer, CBC -Beeville, 3800 Charco Road, Beeville, Texas 78102 at the same location. All Proposals shall be submitted in a sealed envelope and clearly marked: Coastal Bend College -Beeville Campus JAURE -LATCHAM BUILDINGS -HVAC UPGRADES Competitive Sealed Proposals Request for Competitive Sealed Proposals. The Sealed Cost Proposals will then be opened and read aloud. All offerors are invited to attend the proposal opening. Proposals that have been opened may not be changed for the purpose of correction an error in the price. Other than price, a bidder may have the right to change any other error or mistake in the proposal as may be permitted by applicable law and subject to the approval of Owner, unless such change would be in contravention of statutory or common law requirements or unless such change would give an unfair advantage to the bidder making such change. The Owner reserves the right to reject any and all Proposals and to waive any formality in bidding. The Owner reserves the right to reject any and all bids, to waive any and/or informalities and to disregard all nonconforming, non-responsive or conditional bids. The Owner intends to execute a contract on a "Best Value Basis", based upon the Owner's available budget for this project Award of a contract, if any, will be made to the bidder who submits the proposal that offers the best value for the Owner, based on (a) Price; (b) Schedule; (c) other considerations. The Owner may reject any and/or all bids. The Owner has designated the immediate need for this Project to constitute an "emergency" and thus has forgone the advertisement for bidding. The Project includes minor demolition, hazardous materials removal, removal of existing HVAC equipment and installation of new HVAC equipment, removal and replacement of existing pumps, piping, and electrical service upgrades. The work must be completed within the timeline which is outlined in Specifications Section 01 15 00- Phasing and Sequencing Bidders must submit questions concerning the Contract Documents to the Project Architect in writing. Clarification will be made to the inquiring Bidder by Addendum. Questions of bidders may be discussed by email as a convenience to the bidder but are not binding unless confirmed by Addendum issued by the Project Architect to all Bidders. Any discrepancies within the Contract or Bidding Documents, including between the Drawings and Specifications, or errors must be reported to the Project Architect for interpretation.
