The Santa Clara Valley Transportation Authority ("VTA") is requesting electronic bids ("Bids"; "Bid") from responsive and responsible qualified firms ("Bidders") for fencing repairs and replacements. Background For purposes of this Contract, Work consists of furnishing all labor, materials, tools, equipment, services, supervision, and incidentals as necessary for Fencing Repairs and Replacements project. The Work will be conducted within an operating rail yard and adjacent to and within existing shop facilities. This Work will be subject to restrictions to ensure safety and the continuing operations of the yard and shop and the light rail system. The Contractor shall fully comply with VTA's policies and procedures regarding the utilization of SBE firms. In order to be counted for SBE credit, all SBE firms that will perform work, labor and/or render services must be identified on Bid Form 4 (Listing of SBE Bidder or Subcontractors), verified by VTA's Office of Business Development Program ("OBDP") as certified by VTA at the time of Bid submission. The SBE Commitment stated in the approved Bid Form 4 (Listing of SBE Bidder or Subcontractors) equates to a commitment from the Bidder. The Contractor must meet this commitment in the performance of the Contract. If a Bidder does not meet the Contract Goal, it is required to submit documentation evidencing Good Faith Efforts. This documentation must be submitted within the time frame provided in Section 6.2 (Timing of Good Faith Efforts Submission) of this Appendix.
