Bidders are required to havean Arkansas Contractor's License when the cost of the work to bedone by the Contractor including,but not limited to, labor and materials, is $20,000.00 or more, thisis in accordance with ArkansasCode Annotated 17-22-101, et.seq.; The work to be performedunder this contract is subject tothe requirements of section 3 ofthe Housing and Urban Development Act of 1968, as amended, 12U.S.C. 1701u (section 3). Each bid submitted mustcontain the following items: (1) Bid form, signed by bidder; (2) Bid guarantee in an amountequal to five percent (5%) of the bid price, the bid guaranty can bein the form of a certified check or cashier's check made payable to the PHA, a U.S. Government bondendorsed to the PHA, or a bidbond executed by the bidder inaccordance with HUD-5369,Clause 9; (3) Representations, Certifications and Other Statements ofBidders - Public and Indian Housing Program Form HUD5369-A; (4) A Non-Collusive Affidavitform which must be submitted ifyour bid is over $50,000.00; (5) Previous Participation Certification, Form HUD-2530, form which must be submitted if yourbid is over $50,000.00. (6) Certification of Bidder Regarding Section 3 and SegregatedFacilities. (7) Contractors Section 3 Plan Format (8) Certification of Prime BidderRegarding Equal Employment Opportunity. (9) Certification of Prime BidderRegarding Non-Segregated Facilities. (10) Contractor's CertificationConcerning Labor Standards and Prevailing Wage Requirements. The successful bidder shall be required to furnish an ArkansasPerformance and Payment Bond or Bonds on the form contained inthe Contract Documents in theamount of 100% of the fullamount of the bid. This is in accordance with Arkansas Code Annotated 19-11-405. Nonresidentcontractors shall be required tocomply with the requirements ofAct 489 of 1989, pertaining toContractors Bonds. The PHA reserves the right toreject any or all bids, separately orin their entirety; to accept or reject any Bid by line item; to waive any informalities in the bidding; toconsider and award Bids in amanner that will be in the best interest and most advantageous tothe PHA, to the lowest responsiveand responsible bidder or bidders, as appropriate, whose bid or bids,as appropriate, conforms or conform, as appropriate, with all the material terms and conditions ofthe Invitation for Bids. No bid shall be withdrawn for aperiod of 60 days subsequent tothe opening of bids without theconsent of the PHA.
