For the construction of the "Lead service line replacement project, spencer, iowa, in accordance with the plans and specifications now on file in the office of the general manager/ceo of smu. The lead service line replacement project, spencer, iowa, consists of: replacing existing lead and/or galvanized steel water service materials with new water service line materials between the existing water main and the water meter at 237 properties within the city of spencer, iowa. The project includes removal and replacement of existing street, driveway and sidewalk pavements and site restoration. Major items of construction and approximate quantities thereof for the lead service line Replacement project, spencer, iowa are as follows: Mobilization 1 lump sum Traffic control 1 lump sum 3/4" or 1" water service line 12,000 ln ft Corporation cock w/ saddle 194 each Curb stop w/ box 210 each Connection to existing meter 130 each Remove and replace street pavement 2,500 sq yd Lawn restoration - urban seeding 237 each Work on the project can commence upon the issuance of a Notice to Proceed and is expected to begin approximately April 1, 2026. The contractor shall complete all work covered by the contract on or before October 15, 2027. The Contractor shall complete the work on intermediate portions of the project within the number on calendar days specified under DSA-1 Scheduling of Construction. The work shall be in accordance with the plans, specifications, and proposed form of contract now on file in the office of Spencer Municipal Utilities, Spencer, Iowa, by this reference made a part hereof, as though fully set out and incorporated herein. ach proposal/bid shall be made out on a proposal form furnished by the Engineer and must be accompanied by bid security as defined in Iowa Code Section 26.8, as security that the successful bidder will enter into a contract for the work bid upon and will furnish after the award of contract a corporate surety bond, in a form acceptable to the Utility, for the faithful performance of the contract, in an amount equal to 100% of the amount of the contract. The bidder's security shall be in the amount equal to five percent (5%) of the amount of the Bid and shall be in the form of a cashier's check or a certified check drawn on an FDIC insured bank in Iowa or on an FDIC insured bank chartered under the laws of the United States; or a certified share draft drawn on a credit union in Iowa or chartered under the laws of the United States; or a bid bond on the form provided in the contract documents with corporate surety satisfactory to the Utility. The bid security shall be made payable to Spencer Municipal Utilities. The bid security must not contain any conditions either in the body or as an endorsement thereon. Such bid security shall be forfeited to the Utility as liquidated damages in the event the successful bidder fails or refuses to enter into a contract within fifteen (15) days after the award of contract and post satisfactory Performance and Payment Bonds. No oral facsimile, telegraphic, or telephonic bids or modifications will be considered. The Contractor shall furnish a Performance and Payment Bond in an amount equal to one hundred percent (100%) of the amount of the contract. Said bond to be issued by a responsible surety approved by SMU and shall guarantee the faithful performance of the contract and the terms and conditions therein contained and shall protect and save harmless SMU, and KRUSE, CATE & NELSON, P.C., Spencer, Iowa, from claims and damages of any kind caused by the construction of said improvements, and shall also guarantee the maintenance of said improvements in good repair for not less than two (2) years from the date of final acceptance of the improvements. The Contractor shall observe the laws of the State of Iowa with reference to "Preference for Iowa Products and Labor," and "Occupational Safety and Health Standards". This project is to be funded in part by a State Revolving Fund (SRF) Loan, and is therefore subject to certain labor standards and federal requirements included in the Contract Documents. Contractors performing work on the project shall comply with the requirements as enumerated in the Required Front-End Specifications for SRF projects. Minimum wage rates to be paid employees have been determined by the U.S. Department of Labor and are listed in the Contract Documents. The Contractor/ Subcontractors will be required to comply with the wage and labor requirements and to pay minimum wages in accordance with the schedule of wage rates. Build America, Buy America (BABA) material requirements apply to this project. Payment to the Contractor for said construction work will be made from cash on hand or such other funds that legally may be used or obtained for such purposes. Estimates will be paid monthly by Spencer Municipal Utilities to the Contractor in accordance with the provisions of Chapters 26 and 573 of the Code of Iowa, as amended, in accordance with the following schedule: Ninety-seven percent (97%) upon certification of units completed; three percent (3%) thirtyone days after final completion and acceptance. To the extent required by Iowa law, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country if that state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type of labor force preference or any other form of preferential treatment to bidders or laborers from that state or foreign country. The preference allowed shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident. Failure to submit a fully completed Bidder Status Form, Certificate of Non-Discrimination, and SRF Attachments with the Proposal may result in the Proposal being deemed nonresponsive and rejected. Contractors shall use their best efforts to solicit bids from and to utilize minority group contractors and subcontractors, or contractors and subcontractors with meaningful minority group and female representation among their employees. Spencer Municipal Utilities may make the Contract award to the lowest responsive, responsible bidder meeting the specifications, subject to concurrence from Iowa SRF and the following. The Utility reservesthe right to defer acceptance of any bid for a period not to exceed thirty (30) days after the date bids are received and no bid may be withdrawn during this period. The Utility also reserves the right to waive informalities and irregularitiesin the form of the bid, reject any or all bids, and enter into such contract, or contracts, as it shall deem to be in the best interest of the Utility. This Notice is given by authority of the Board of Trustees of Spencer Municipal Utilities.
