The project is expected to be awarded on January 15, 2026.** DSA Application No. 04-124932 Contractor's License Classification Required: Each bidder and all subcontractors shall be a licensed contractor pursuant to the California Business and Professions Code and shall be licensed to perform the work called for in the contract documents. License Classification: B Each bid must strictly conform with and be responsive to the contract documents as defined in the General Conditions. The District reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding. Each bidder shall submit with his bid, on the form furnished with the contract documents, a list of the designated subcontractors on this project as required by the Subletting and Subcontracting Fair Practices Act, California Public Contract Code Sections 4100 et seq. In accordance with California Public Contract Code Section 22300, the District will permit the substitution of securities for any moneys withheld by the District to ensure performance under the contract. At the request and expense of the Contractor, securities equivalent to the amount withheld shall be deposited with the District, or with a state or federally chartered bank as the escrow agent, who shall then pay such moneys to the Contractor. Each bidder's bid must be accompanied by one of the following forms of bidder's security in an amount not less than ten percent (10%) of the total bid price: (1) cash; (2) a cashier's check made payable to the District; (3) a certified check made payable to the District; or (4) a bidder's bond executed by a California admitted surety as defined in Code of Civil Procedure Section 995.120, made payable to the District in the form set forth in the contract documents. Pursuant to California Labor Code Sections 1720 et seq., it shall be mandatory upon the Contractor to whom the contract is awarded, and upon any subcontractor under such Contractor, to pay not less than the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed to execute the contract, including holiday and overtime work as well as employer payments for health and welfare, pension, vacation, and similar purposes. A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in the Labor Code, unless currently registered and qualified to perform public work pursuant to Labor Code section 1725.5. Formal AB2031 Prequalification of Bidders and MEP Subcontractors For Projects using funds received that involves a projected expenditure of $1,000,000 or more As a condition of submitting a bid for this Project, and in accordance with California Public Contract Code section 20111.6, any prime bidder/ prime contractor that holds an A, B, C-4, C-7, C-10, C-16, C-20, C-34, C-36, C-38, C-42, C-43 or C-46 license must be prequalified. Additionally, if this Project includes work that will be performed by mechanical, electrical or plumbing ("MEP") subcontractors (contractors that hold C-4, C-7, C-10, C-16, C-20, C34, C-36, C-38, C-42, C-43 or C-46 licenses), such MEP subcontractors must also be prequalified. A list of prequalified MEP subcontractors will be made available by the District to all bidders at least five business days prior to the bid opening date. It is the responsibility of the bidder to ensure that all MEP subcontractors holding any of the licenses listed above are properly prequalified before submitting a bid. This prequalification requirement applies even if the prime contractor or subcontractor will perform, or is designated to perform, work that does not require one of the licenses listed above, but the prime contractor or subcontractor holds one of the licenses listed above. No bidder may withdraw any bid for a period of ninety (90) calendar days after the date set for the opening of bids. Separate payment and performance bonds, each in an amount equal to 100% of the total contract amount, are required, and shall be provided to the District prior to execution of the contract and shall be in the form set forth in the contract documents. All bonds (bid, performance and payment) must be issued by a California admitted surety as defined in California Code of Civil Procedure section 995.120. Any additive or deductive alternates to the base bid used to determine the lowest bid will be considered using the method specified in the Notice Inviting Bids set forth in the contract documents and in accordance with Public Contract Code section 20103.8. Each bidder must strive to meet goals and requirements relating to participation by Disabled Veteran Business Enterprises ("D.V.B.E."), of three percent (3%) participation, established by the District, or make a good faith effort in respect thereto and provide the District with a report as to the actual participation at the conclusion of the Project. Any request for substitutions pursuant to Public Contracts Code Section 3400 must be made on the form set forth in the contract documents and submitted not less than seven business days prior to the bid opening date. Bidders should carefully review the required timing for DSA approval of documents and subsequent manufacture, delivery, installation, and other work required for this Project as set forth in the Agreement Form. Bidders should carefully review these requirements prior to submitting bid. The Contract Time is 77 days A. The DISTRICT may have separate contracts with other CONTRACTORS, vendors, suppliers, or entities to perform Work on the Project. This may include, but is not limited to Multi-Prime CONTRACTORS, furniture installers, testing agencies, clean-up CONTRACTORS, or network or low voltage CONTRACTORS. CONTRACTOR shall plan for certain other CONTRACTORS that may also be working on the Project site and address these other CONTRACTORS. If the District chooses to employ a third-party Labor Review entity; in ADDITION to the DLSE, all Contractors and their subcontractors of all tiers must adhere to the software submission, review and monitoring requirements of said selected entity. B. The DISTRICT may have separate contracts with other CONTRACTORS, vendors, suppliers, or entities to perform Work, on the project. This may include, but is not limited to Multi-Prime CONTRACTORS, furniture installers, testing agencies, clean-up CONTRACTORS, or network or low voltage CONTRACTORS, CONTRACTOR shall plain for certain other CONTRACTORS. C. The DISTRICT has contracted with a CONSTRUCTION MANAGER. The CONSTRUCTION MANAGER is a consultant to the DISTRICT to assist in Project planning, management and construction of the Project. They may assist in various aspects of the Project including, but not limited to monitoring the progress of the construction, reviewing and monitoring the schedule, progress of work, monitoring pay requests, facilitating communications, advising the DISTRICT and its Board of Education on various aspects of the construction process, monitoring the RFI, COR, CCD, ICD, RFP, Claims, Disputes and other Project related processes. All communications regarding the Project shall be done through the CM and any communications related to the Project shall copy the CONSTRUCTION MANAGER. D. This project will have the following Bid Categories: BC 01: Site Work CONTRACTOR shall continually supervise and direct the Work using the CONTRACTOR'S best skill and attention. CONTRACTOR shall be solely responsible for and have control over construction means, methods, techniques, sequences, procedures; and shall coordinate all portions of the Work under the Contract, unless the Contract Documents give other specific instructions concerning these matters. CONTRACTOR shall not perform the Work without utilizing the Contract Documents or, where required, approved Submittals, Shop Drawings, or samples for any such portion of the Work. If any of the Work is performed by CONTRACTORS retained directly by the DISTRICT, CONTRACTOR shall be responsible for the coordination and sequencing of the work of those other CONTRACTORS so as to avoid any impact on the Project Schedule.
