The project consists of the replacement of approximately 2,220 linear feet of 8-inch sanitary sewer mains including the replacement of associated manholes and services within the rights-of-way of Trinity and La Salle Streets in the City of Port Lavaca, Texas The project to be constructed will be financed with assistance from the Texas Department of Agriculture (TDA) under the U.S. Department of Housing and Urban Development Community Development Block Grant (CDBG) program and is subject to all applicable Federal and State laws and regulations. This solicitation is for services related to a project that is subject to the Build America, Buy America Act (BABA) requirements under Title IX of the Infrastructure Investment and Jobs Act. Absent an approved waiver, all iron, steel, manufactured products, and construction materials used in this project must be produced in the United States. Bidders must submit a bid bond, cashier's or certified check payable without recourse to the order of the City of Port Lavaca in an amount not less than five percent (5%) of the bid submitted as a guarantee that the Bidder will enter into a contract and execute bonds and guarantees in the forms provided within fifteen (15) days after Notice of Award of contract to them. Bids submitted without the required security will not be considered. Attention is called to the fact that not less than the federally determined prevailing (Davis-Bacon and Related Acts) wage rate, as issued by the Texas Department of Agriculture Office of Rural Affairs and contained in the contract documents, must be paid on this project. In addition, the successful Bidder must ensure that employees and applicants for employment are not discriminated against because of race, color, religion, sex, sexual identity, gender identity, or national origin. All contractors and subcontractors must be cleared (not suspended or debarred) prior to any formal action authorizing the award of a contract to the contactor. Minority Business Enterprises, Small Business Enterprises, Women Business Enterprises, Veteran-Owned Businesses, and Section 3 Businesses are encouraged to submit bids. The City of Port Lavaca reserves the right to reject any or all bids or to waive any informalities in the bidding. Bids may be held by the City of Port Lavaca for a period not to exceed 60 days from the date of the bid opening for the purpose of reviewing the bids and investigating the Bidder's qualifications prior to the contract award. The successful Bidder will be required to purchase and furnish a Performance Bond and a Payment Bond, each in the amount of the contract, written by a responsible surety company, authorized to do business in the State of Texas, as required by Article 5160, V.A.T.C.S., as amended by H.B. 344, passed by the 56th Legislature, Regular Session, 1959. Bidders are expected to inspect the site of the work and to inform themselves regarding all local conditions.
