PROJECT 2501 The contract provides for the repair, construction, and finishing of asphaltic concrete pavements throughout the city limits of Ardmore, Oklahoma. Bids must be made in accordance with the Instructions For Bidders contained in the Contract Documents. Bid security in the form of a cashier's check, certified check, or Surety Bond in the amount of five percent (5%) of the Base Bid must accompany each Bidders sealed bid. The Bidder must use the City's Bid Proposal and affidavits, ensure all forms are signed and notarized, and file the bid in a sealed envelope marked with the project and Bidder name. The Successful Bidder must deliver the executed Contract and Bonds along with certificates of insurance as required in the Contract Documents to the City within fifteen calendar days following notification of intent to award. The City may issue addenda, reject any or all bids, waive immaterial defects or irregularities, and reserves the right to award the bid in the manner it deems in its best interest. Alteration of Plans or Character of Work. The Engineer shall have the right, subject to approval by the City Commission in some circumstances, to increase or decrease the extent of the work or to change the location, gradient, or the dimensions of any part of the work, provided that the length of the improvement is not increased or decreased in excess of 15% of the Contract length, or that the quantities of work to be done or the materials to be furnished are not increased or decreased in money value in excess of 15% of the total Contract. Such changes shall not be considered as a waiver of any conditions of the Contract nor invalidate any of the provisions thereof. The CONTRACTOR shall perform the work as increased or decreased within the qualifying limits named and no allowance will be made for anticipated profits on increases or decreases so incurred. In the event that the Contract cost exceeds One Million Dollars ($1,000,000.00), the total value of any such changes is limited to 10% instead of 15%. 5.2 Significant Changes in the Character of Work. The ENGINEER reserves the right to make, in writing, at any time during the work, such changes in quantities and such alterations in the work as are necessary to satisfactorily complete the project. Such changes in quantities and alterations shall not invalidate the Contract nor release the Surety, and the CONTRACTOR agrees to perform the work as altered. If the alterations or changes in quantities significantly change the character of the work under the Contract, whether or not changed by any such different quantities or alterations, an adjustment, excluding loss of anticipated profits, will be agreed upon prior to the performance of the work. If a basis cannot be agreed upon, then an adjustment will be made either for or against the CONTRACTOR in such amount as the ENGINEER may determine to be fair and equitable. If the alterations or changes in quantities do not significantly change the character of the work to be performed under the Contract, the altered work will be paid for as provided elsewhere in the Contract. The Contract Documents are available in digital format at no charge and will be sent via Dropbox. Bid Opening Sealed bids will be opened shortly after 2:00 PM, CST on Thursday, January 29, 2026, in no particular order and read aloud. Bids will be opened in the First Floor Conference Room, City Hall, 23 South Washington Street, Ardmore, OK 73401. Upon opening, the City Clerk, or their representative, shall verify that the bid is presented on the designated Bid Proposal and that the bid is accompanied by the required Bid Bond or suitable substitute. Bids without bid surety will not be read nor tabulated.
