County Executive Office Real Estate, on behalf of the County of Orange ("County") and Orange County Flood Control District ("District"), is soliciting Proposals, including a Site Feasibility Report, from qualified outdoor advertising companies ("Proposers") to design, construct, maintain, and operate digital billboards on County-owned and/or District-owned sites. The successful Proposer will be recommended to negotiate the terms of an agreement(s), which may include an Option and Ground Lease Agreement(s). The Primary or Secondary Proposer (if applicable) and negotiated agreement(s) will then be recommended to the County Board of Supervisors for approval. Property owned by the County or District in Orange County, Riverside County and San Bernardino County may be available for billboard development. Proposers must identify and select available land that would be viable billboard sites. Proposers are not to contact other County or District staff personnel with any questions or clarifications concerning this RFP. The County Project Contact will provide all official communication concerning this RFP. Any County or District response relevant to this RFP other than through County Project Contact is unauthorized and will be considered invalid. The County and District reserve the right to: (1) accept or reject any and all Proposals or any part of any Proposal, and to waive minor defects or technicalities in same; (2) request clarification of any information contained in a Proposal; (3) solicit new Proposals on the same project, or on a modified project, which may include portions of the original RFP, as the County may deem necessary; (4) disregard all non-conforming, non-responsive, or conditional Proposals; (5) reject any Proposal that does not pass the evaluation to the satisfaction of the County and/or District; (6) allow for the correction of errors and/or omissions; (7) select the Proposal(s) that will best meet the needs of the County and/or District; and/or (8) negotiate an Option and Lease with a Primary Proposer for one or multiple sites or negotiate multiple Options and Leases with one or multiple Proposers for one or multiple sites.
