Bituminous Materials and Tack Oil are to be provided as per the most current Indiana Department of Transportation (INDOT) specifications, Section 400 for this material. Each vendor must submit a bond equal to 5 percent (5%) of the bid amount, along with all documents required by the City of Bloomington and the State of Indiana, as outlined in the instructions to bidders. For projects exceeding $10,000.00 that will result in a contract, a Contract Compliance Certification form and Living Wage Affidavit (when applicable) must be submitted before entering into a contract. The Contract Compliance Certification form requires compliance with all federal laws and regulations related to Equal Employment Opportunity and Anti-Discrimination laws for the contract term(s). Each respondent must confirm that they have a written Harassment Policy as defined by the City, and that they do not operate any programs promoting Diversity, Equity, and Inclusion (DEI) that violate any applicable federal anti-discrimination laws. The Living Wage Affidavit affirms compliance with Bloomington Municipal Ordinance 2.28 if considered a "covered employer." Employers subject to the code are required to pay their covered employees a living wage. Currently, the 2026 Living Wage is $16.66 per hour, up to $2.50 of which may be provided in the form of the employer's contribution to health insurance. The Board of Public Works reserves the right to waive any informality and to accept or reject any or all bids submitted. Bids may be held for a period not to exceed sixty (60) days from the date of the opening of bids for the purpose of reviewing the bids and investigating the qualifications of the bidders prior to awarding the contract.
