Deadline For Questions: Sunday, February 22nd, 2026 If bid exceeds $50,000, a certified check or surety bid bond in the amount of five percent (5%) of the total bid shall accompany the sealed bid of each bidder, designating the Edmond Public Schools and L5 Construction, as dual obligees. Security checks will be returned to all but the three lowest bidders after the bid opening. The three lowest bid securities will be retained as provided in the Instructions to Bidders. The Owner/Construction Manager reserve the right to reject any or all bids and to waive all formalities or minor irregularities. Bidders must agree to commence work on a date to be specified in a written Notice to Proceed and to achieve substantial completion no later than July 31st, 2026 and milestones in accordance with the Construction Manager's schedule. Bidder acknowledges and agrees that the actual damages to be suffered by Construction Manager in the event of delays is difficult, if not impossible, to determine with certainty. Therefore Bidder agrees to pay liquidated damages in the amount of Five Hundred Dollars ($500) for each consecutive calendar day beyond the date set forth for substantial completion. The Bidder also agrees to fully complete the punch list within thirty (30) consecutive calendar days after substantial completion. Bidder agrees to pay liquidated damages in the amount of Two Hundred Fifty Dollars ($250) for each consecutive calendar day beyond the date set forth for final completion. Bidder agrees that the daily rates of liquidated damages set forth herein represent reasonable estimates of the actual damages that could be suffered as a result of delays, and do not constitute a penalty.
