Sealed bids are requested for the award of a contract for Terra Cotta M.S. Parking Lot Improvements. All bids must be submitted on the forms provided. The contract duration is 64 days, with an estimated project cost of $4,500,000.00 and an unforeseen conditions allowance of $200,000.00. Bidders must consult the General Conditions, Supplementary Conditions, and General Requirements regarding milestones and liquidated damages. All bids must be presented and received at the specified location prior to the stated deadline, and will be publicly opened and read aloud. Each bid must strictly conform to and be responsive to the contract documents. The district reserves the right to reject any or all bids or waive any irregularities or informalities. Bidders must submit a list of designated subcontractors with the bid, as required by law. Substitute securities for any moneys withheld are permitted. Each bid must be accompanied by an acceptable form of bid security in an amount not less than ten percent (10%) of the maximum bid amount as a guarantee that the bidder will enter into the contract and provide the required performance and payment bonds, insurance certificates, and other necessary documents. Payment and performance bonds, each in an amount equal to 100% of the total contract amount, are required. All work must comply with prevailing wage laws, and detailed certified payroll records must be submitted electronically. Requirements related to Disabled Veteran Business Enterprise (DVBE) Programs and Public Contract Code stipulations are included. Requests for substitutions must be made at the time of bid and included with the bid on the prescribed form. No bid may be withdrawn for 90 days after opening. It is solely the bidders responsibility to ensure timely delivery of bids to the designated location. Pre-qualification Requirements: Prequalification of bidders is mandatory. Prospective bidders must submit prequalification documents on district-provided forms in accordance with California Public Contract Code section 20111.6. Bids will not be accepted if the contractor has not been prequalified. Prequalification is also required for mechanical, electrical, or plumbing (MEP) subcontractors holding specified licenses. The successful bidder must possess a valid and active Class A and B license at the time of bid and throughout the project. Contractors and subcontractors must be registered and qualified to perform public work under Labor Code section 1725.5. Attendance at the mandatory pre-bid conference is required. Appeal: If the protesting bidder or the apparent low bidder is not satisfied with the decision, the matter may be appealed to the James Judziewicz, james.judziewicz@leusd.k12.ca.us or their designee, within three (3) business days after receipt of the Districts written decision on the bid protest.
