The work generally consists of earthwork to repair the lagoon levee, placing rip rap on interior levee slope. The above general outline of features of the work does not in any way limit the responsibility of the Contractor to perform all work and furnish all labor, equipment and materials required by the specifications and the drawings referred to therein. All bids shall be marked Bids for Town of Kilmichael - 2025 CDBG Wastewater Lagoon Improvements on the outside of the envelope and submitted in duplicate, sealed and deposited with the Town of Kilmichael prior to the specified hour and date. Each Bidder shall write their Certificate of Responsibility Number on the outside of the sealed envelope containing their proposal. Each Bidder must deposit with their proposal, a Bid Bond or Certified Check in an amount equal to five percent of their bid, payable to the Town of Kilmichael, as bid security. The successful bidder will be required to furnish a Payment Bond and Performance Bond each in the amount of 100 percent of the contract amount. No bidder may withdraw their bid within 90 days after the actual date of the opening thereof. Awarding public contracts to non-resident Bidders will be on the same basis as the non-resident bidder's state awards contracts to Mississippi Contractors bidding under similar circumstances. In order to ensure that Mississippi's so-called Golden Rule is followed, state law requires a non-resident bidder to attach to their bid a copy of their resident state's current laws pertaining to such state's treatment of non-resident contractors. The Contractor is fully responsible for the timely delivery of sealed bids. Bid documents are being made available electronically and via paper copy (if requested). Bid documents are non-refundable and must be purchased through the website. Bidders may be required to submit a current financial statement if requested by the Town of Kilmichael.
