Terracon Project No. 03255043 Reference Number 0000416799 GENERAL A. Liquidated damages are not a condition of the prime contract, therefore, liquidated damages shall not be assessed as outlined in the Subcontract agreement. B. Subcontractors are required to obtain contractor licenses, prequalification, permits, etc as required by authorizing jurisdiction. This shall be included in cost of work. Where prequalification is required for authorizing jurisdiction, the prequalification from CM shall not be considered as overriding to authorizing jurisdiction prequalification requirements. C. Trade partner shall provide adequate manpower to manage and staff the project as indicated in project schedule. D. Trade Contractor has visited and carefully studied the site conditions above and below grade which may affect cost, progress or performance of the work and/or means, methods, techniques, sequences and procedures of construction expressly required by the bidding documents to be employed by the Trade Contractor and considerations are included in the bid. E. The bidding documents are generally sufficient to indicate and convey understanding of all the terms and conditions for the work performance of the work for which this bid is submitted. The Trade Contractor acknowledges the more stringent requirements should a conflict between the Construction Documents, building code and requirements and manufacturer s recommendation arises without compromising design intent. F. During all phases of the Project, the Subcontractor shall purchase and maintain insurance that meets requirements outlined in the Sample Subcontract Form included as part of the bidding documents. G. Trade Contractor assumes all risk of all price increases associated with the cost of their work. Examples of this are material price escalation, lack of availability of materials, labor shortages, etc H. Trade Contractor has given Lingo Construction written notice of all conflicts, errors, ambiguities, or discrepancies that the Trade Contractor has discovered in the Bidding Documents and the written resolution by the Architect or Engineer is acceptable to the Trade Contractor. I. J. Trade Contractors will be required to coordinate with Construction Manager as well as other Trade Contractors. If any conflict occurs, immediately notify Construction Manager. All specifications (including Divisions 00 and 01) are part of this bid package. K. Trade Contractor shall review all exhibits prior to bidding. Exhibits are considered part of the bidding documents. L. Trade Contractors are responsible for taking precautions to protect their work as well as adjacent property (such as utilities, city roads & streets, private property, etc.). M. Construction Manager or Owner will provide Builder s Risk Insurance. Deductibles shall be the responsibility of the Trade Contractor if the event was a result of the Trade Contractors failure to secure, store, or protect from loss. Trade Contractor shall be required to provide insurance for stored materials. Subcontractor tools, equipment and personal goods are the responsibility of the subcontractor and not covered by builder s risk. N. Bidder acknowledges that bid does not include substitutions unless protocols outlined in specifications are followed and approved prior to the time of bid. After time of bid substitutions will no longer be considered. O. Bidder acknowledges that, if accepted by the Owner, bid and corresponding bid package becomes a part of the Contract Documents. P. Bidder acknowledges that in submitting this bid the Sample Subcontract has been reviewed and is acceptable for contract terms. Q. Bidder acknowledges that any cashier s checks or certified checks submitted as their bid bond will be held for a period of sixty (60) days after scheduled closing time for bids. Upon completion of that time, any bidder who was not awarded a contract, and who turned in a cashier s check or certified check will have that check made available for pickup at the office of the Construction Manager. When the Notice to Bidders specifies that the Pre-Bid Conference is mandatory, the contractor who plans to submit a bid must attend the Mandatory Pre-Bid Conference. Failure of the prospective bidders to attend a Mandatory Pre-Bid Conference will cause the bidder's submission to be rejected. Whenever required, a Mandatory Pre-Bid Conference is a prequalification requirement to bid on the contract.
