Highland County, State of Ohio, through its Board of County Commissioners, will receive bids for the 2026 Highland County Chip Seal Program as per specifications. Bids are to be electronically submitted through the https://bidexpress.com service. No paper bids will be accepted. Each bidder is required to furnish with its proposal, a Bid Guaranty and Contract Bond in accordance with Section 153.54 of the Ohio Revised Code. Bid security furnished in Bond form must be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety. The project must be completed no later than August 28, 2026. All contractors and subcontractors involved with the project must, to the extent practicable, use Ohio Products, materials, services, and labor. Contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123 is required. Bidders must comply with prevailing wages rates on Public Improvements in Highland County, Ohio as determined by the Ohio Department of Commerce, Bureau of Wage and Hour Administration. The Highland County Board of Commissioners reserves the right to accept the lowest and best bid, reject any and all bids, and to waive any irregularities in bids. The contractor hereby agrees that the said owner shall be and are hereby authorized to deduct and retain out of the moneys which may be due or become due to the said contractor, under this agreement, as damages for the non-completion of the work aforesaid within the time hereinbefore stipulated for its completion or within such further time as in accordance with the provision of this agreement shall be fixed or allowed for such performances or completion, the sum of $1,000 per day for contract amounts from $0 to $500,000, and $1,500 per day for all contracts over $500,000 for each and every day the time employed upon said work may exceed the time stipulated for its completion, or such stipulated time as the same may be increased, as hereinbefore provided, which said sum of $1,000 per day for contract amounts from $0 to $500,000 and $1,500 per day for all contracts over $500,000 is hereby, in view of the difficulty of estimating such damages, agreed upon, fixed and determined by the parties hereto as the liquidated damages that the owner will suffer by reason of such default and not by way of penalty. he contractor shall furnish a surety bond (form attached) in the amount at least equal to 100% of the contract price as security for the faithful performance of this contract and for the payment of all persons performing labor and furnishing materials in connection with this contract.
