Guarantee will be required with each bid as follows: A certifiedcheck on a solvent bank or a bid bond in the amount of five (5) percent of the total amount of bid,made payable to the BatesvilleAirport Commission. All bidders and proposers shall make good faith efforts, as defined in Appendix A of 49 CFR Part 26, Regulations of the Office ofthe Secretary of Transportation, tosubcontract % of the dollar valueof the prime contract to smallbusiness concerns owned andcontrolled by socially and economically disadvantaged individuals (DBE). In the event that thebidder for this solicitation qualifies as a DBE, the contract goal shallbe deemed to have been met. Individuals who are rebuttably presumed to be socially andeconomically disadvantaged included women, Blacks, Hispanics,Native Americans, Asian-PacificAmericans, and Asian-IndianAmericans. The apparent successful bidder (proposer) will be required to submit informationconcerning the DBE's that willparticipate in this contract. The information will include the nameand address for each DBE, a description of the work to be performed by each named firm, and the dollar value of the contract(subcontract). If the bidder fails to achieve the contract goal statedherein, it will be required to provide documentation demonstrating that it made good faith effortsin attempting to do so. Liquidated damages for delaywill be provided in the Specifications. The right is reserved, as thethe Batesville Airport Commission may require, to reject any and all bids and to waive any informality in bids received. Bidders arehereby notified that all bids may be rejected if the lowest responsive bid received exceeds the Engineer's estimate by more than7% and it is determined that anaward of contract would causeexcessive inflationary impact. No bidder may withdraw his bidwithin a period of 90 days fromthe date of the opening.
