Proposals shall be based on the requirements set forth in the Barton Malow Builders project manual and construction bidding documents prepared by French Associates project drawings and specifications for Bid Category 21 0000 Fire Suppression. Accepted Bidders will be required, as a condition precedent to award of Contract, to furnish a satisfactory Performance Bond and Payment Bond and Certificates of Insurance as required in the Project Manual. The Project is subject to state sales and/or use taxes and Bidder is required to include such taxes in its Bid Proposal. The Project is not subject to prevailing wage rates. Barton Malow Builders has been contracted by the Owner in the capacity of Construction Manager for the Project and shall act as representative of the Owner as required. Bidders may be required to be pre-qualified to the requirements described in the Instructions to Bidders before document distribution or receipt of bids. Barton Malow Builders reserve the right to request qualification forms or additional information from any Bidder before issuing Bidding Documents, receiving Bid Proposals, or awarding the Agreement. Bid Proposals shall be on forms furnished by Barton Malow Builders via Building Connected. Bidders shall not withdraw or revoke Bid Proposals for a period of 90 Days after date for receipt of Bid Proposals. Bidders will be required to submit with their Bid Proposals a Bid Security, in the amount of 5% of base bid, by a qualified surety authorized to do business in the state where the Project is located. Bidders with an Experience Modification Rate (EMR) greater than 1.0 may not be considered for contract award. The successful bidder will be required to enter into a contract with Lapeer Community Schools on the AIA Document A132-2019 Standard Form of Agreement between Owner and Contractor, Construction Manager as Advisor Edition. The Owner reserves the right to accept or reject any or all offers.
